Do I need make a Building Regulation Application to replace the windows/doors in my house?

On 1 April 2002 new regulations were introduced to control replacement windows and doors in existing domestic properties.

A Building Regulation application is not necessarily required as there are two different, but equally acceptable ways, of satisfying the regulations.

There are currently two self-certification schemes in operation for replacement windows, ‘FENSA’ and ‘Certass’. This system allows installation companies that meet certain criteria to self-certify that their work complies with the Building Regulations. A sample of the work of every installer will be inspected by FENSA or Certass appointed inspectors to ensure standards are maintained.

FENSA or Certass will inform the Building Control Department of all completed installations and issue Certificates to householders confirming compliance. These certificates will be required if the property is sold in the future.

If you choose a FENSA or Certass registered company to install the windows/doors you do not need to submit a Building Regulation application to the Council.

Option Two
If you are not using a FENSA or CERTASS registered installer you should submit a Building Notice application at least 48 hours prior to the removal of existing windows. A set charge should accompany the notice (please refer to Table C of our charges schedule. A Building Control Surveyor will inspect the installation and check the glazing for compliance with the regulations. Once a satisfactory completion inspection has taken place a Completion Certificate will be issued.

1 - Structural Work
If an opening is made in an existing wall for a new window then it is considered to be a structural alteration and must be inspected by Building Control. Please follow option two above.

2 - Listed Buildings / Buildings in Conservation Areas
A significant proportion of the Island’s building stock would fall into one or more of the following categories: - listed buildings, buildings in a conservation area or buildings which are of architectural and historic interest and fall within Areas of Outstanding Natural Beauty or World Heritage Sites.

If your building falls within one or more of these categories you should seek early advice from the Conservation Team (Tel: 821000), as your building is likely to be exempt from the need to comply with the regulations. However, please note that Planning Permission or Listed Building Consent may still be required for replacing windows within these buildings.

3 - Commercial Property
FENSA registered installers cannot self-certify their work in non-residential property. If you propose to replace the windows you should follow option two above. However, the charge payable is based upon Table E of our charges schedule.
