Section 13(2) of the Criminal Justice and Police Act 2001 provides that a local authority may impose an Order which identifies a place as a designated public place for the purposes of police powers in relation to alcohol consumption, if they are satisfied that a nuisance or annoyance to members of the public or a section of the public has been associated with the consumption of intoxicating liquor in that place.


The order makes it an offence for any person to drink alcohol within the area designated by the order, after being required by a Police Officer not to do so. It is not a device to stop drinking in public places. The Order also provides powers for the police to confiscate and dispose of any alcohol (and container for alcohol), in any person’s possession in such a manner as the police consider appropriate. A person who fails without reasonable excuse to comply with a requirement on him under this Order commits an offence and is liable on summary conviction to a fine not exceeding level 2 on the standard scale (£500).
