Housing Act 2004 – New Housing Law
 
On 18th November 2004 Parliament passed the new Housing Act 2004. This can be viewed here
This Act will:
 
  • Replace the existing Housing Fitness Standard with the HHSRS – Housing Health and Safety Rating System.
  • Introduce a new Mandatory HMO (Houses in Multiple Occupation) Licensing Scheme.
  • Introduce a selective licensing scheme for private rented properties not covered by the Mandatory HMO Licensing Scheme.
The Government introduced Mandatory Licensing of HMO’s of 3 or more storeys, with 5 or more occupiers.  Licenses may only be granted if HMO’s meet certain criteria. One element being that the HMO is reasonably suitable for occupation by the number of persons permitted under the License.
 
Trading without a License will be a criminal offence which may be punishable by a fine of up to £20,000. Isle of Wight Council through the Housing Renewal Section will assist Landlords by inspecting HMO’s in advance of Licensing becoming Mandatory, to spread the cost of any work required and reduce the likelihood of prosecution.
