Why is a thorough, detailed and accurate inventory essential to protect the interests of all parties including the agent?
If an inventory is inadequate, out of date, non-existent or not compiled by an Independent Inventory compiler then the adjudicators or the court are likely to award the deposit to the tenant unless the tenant admits to damage or losses. This has become increasingly common with many inventories being found to be either inadequate at the outset, or failing to make the correct substantiated observations at the check-out.
Recent TDS scheme cases have highlighted the need for a clear, concise inventory to protect the landlord. Many cases have resulted in a full return of the deposit as the landlord could not provide sufficient evidence to successfully pursue their action. Some landlord and property owners are still doing their own inventories and in this instance the chances are it won’t be worth the paper it’s written on and in the event of a dispute the landlord has great difficulty proving their case to a judge or arbitrator. It is estimated that currently fewer than 1 in 50 inventories are of an adequate standard in which event the court will order the landlord to pay the tenant three times the deposit amount within 14 days of the making of the order.
