Penalty Charge Notices (PCN)


Service Description: The Isle of Wight Council enforce parking regulations under the Traffic Management Act 2004. One of the ways in which they do this is by issuing Penalty Charge Notices (PCNs) which are also processed by the local authority. However, PCNs are enforced through the civil justice system, rather than the criminal justice system. Therefore, councils enforcing parking restrictions under the Traffic Management Act 2004 are said to be operating “decriminalised parking enforcement”.

Question: I have received a charge certificate but did not receive the Notice to Owner

Answer: The Council cannot be held responsible for undelivered correspondence. At this stage you are unable to make a representation, you will need to await the Order of Recovery which will be sent to you shortly. The Order for Recovery sets out the grounds on which you may make a Statutory Declaration and, if any of these are applicable, you must serve the declaration directly to the Court within the time permitted.
