Service Description: The Isle of Wight Council enforce parking regulations under the Traffic Management Act 2004. One of the ways in which they do this is by issuing Penalty Charge Notices (PCNs) which are also processed by the local authority. However, PCNs are enforced through the civil justice system, rather than the criminal justice system. Therefore, councils enforcing parking restrictions under the Traffic Management Act 2004 are said to be operating “decriminalised parking enforcement”.

Answer: In due course the full charge of £60 will become due and a Notice to Owner will be sent to you. This Notice to Owner gives the opportunity to make a representation for any one of six reasons (no other grounds will be considered): 1)I was not the owner/keeper of the vehicle at the time of the contravention, 2) The Vehicle had been taken without my consent, 3)We are a hire firm and have supplied the name of the hirer, 4)The Contravention did not occur (for instance if the Penalty Charge Notice is for overstaying on a meter and the time had not expired, or if the Penalty Charge Notice is for parking on a yellow line when you were in fact legally loading). 5)The penalty exceeded the relevant amount, 6)The traffic order was invalid (This applies for instance if the Council had not followed the correct procedure for passing the traffic order) If you make a representation for one of the above reasons and the representation is rejected by the Council, you will be sent a form which gives you the opportunity to have the matter considered by an independent adjudicator. Please note however, you will not be offered a further opportunity to make a reduced payment and that all decisions made by the adjudicator are final. - Related Link
