Service Description: The Law states that parents of a child of compulsory school age must ensure that he/she receives full-time education and if a child fails to attend punctually and regularly then his/her parents are guilty of an offence.

Question: What happens if parents have to go to court for a child’s non-attendance

Answer: If the local authority seeks an Education Supervision Order this will be heard in the Family Court.
This Order gives the local authority power to give reasonable direction to pupil/parent and school. Prosecution in the Magistrates Court can result in a fine of up to £1000 (£2500 for an aggravated offence and/or imprisonment) and/or a Parenting Order.
