Penalty Charge Notices (PCN)


Service Description: The Isle of Wight Council enforce parking regulations under the Traffic Management Act 2004. One of the ways in which they do this is by issuing Penalty Charge Notices (PCNs) which are also processed by the local authority. However, PCNs are enforced through the civil justice system, rather than the criminal justice system. Therefore, councils enforcing parking restrictions under the Traffic Management Act 2004 are said to be operating “decriminalised parking enforcement”.

Question: Late Witness Statement/TE7 What is a Late Witness Statement

Answer: If an individual wishes to file a Witness Statement but the timescale specified for doing so on the Order for Recovery has elapsed, they may apply to file a Late Witness Statement. This application will need to be filed direct with TEC and in addition to the Witness Statement (known as a form TE9) a late application form must be completed (known as a form TE7). The said forms are not Council documents but statutory Court documents which can be downloaded from the Court website (www.hmcourts-service.gsi.gov.uk) under the Form Finder tab. Alternatively, the said forms can be obtained from TEC by telephoning their help desk on 0845 704 5007.
