Business Rates Recovery - Liability Orders


Service Description: The Council will apply to the Magistrates Court to grant a Liability Order for non payment of Business Rates where a summons has been issued and the debt remains outstanding. The Liability Order allows the Council to take further action to collect unpaid Business Rates.

Question: What is a Liability Order and what powers does it give to the court?

Answer: A Liability Order provides us with extra powers in which to obtain the money that is due to us. We can look at setting up a payment arrangement, deduct money from your earnings, deduct money from your Income Support or Jobseekers Allowance or instruct bailiffs to act on our behalf.

When a Liability Order has been granted by the Magistrates Court, it means that the court are satisfied that we have followed the correct procedure for requesting payment of Council Tax and that a balance remains on the account.
