Section 58 of the New Roads and Street Works Act 1991 allows a local authority to protect parts of the highway which have been subject to substantial road works (e.g. reconstruction or resurfacing of the running surface) for a specified period of time.
The Council provides advance notice of these restrictions so that any utility, developer or private contractor etc. can arrange to conduct their works in advance of the restriction coming into force. However, some necessary works such as leaks, or loss of power or service, are exempt from the restriction. And further to this, the local authority cannot unreasonably withhold consent.
