RESOLVED :

 

THAT the minutes of the meeting held on 13 February 2006 be confirmed.

 

104.         DECLARATIONS OF INTEREST

 

There were no declarations of interest made at this stage.

 

105.         REPORT OF THE HEAD OF CONSUMER PROTECTION

 

Consideration was given to Paper B, the report of the Head of Consumer Protection, providing details of an application for the Grant of a Street Trading Consent in respect of Hurstake Road, Riverside Industrial Estate, Newport, received in accordance with the Local Government (Miscellaneous Provisions) Act 1982, Schedule 4.

 

The Sub Committee followed the agreed procedure, which had been previously circulated to all parties prior to the meeting.  After the hearing of the application, the Sub Committee presented the following decision and the reasons for that decision.

 

RESOLVED:

 

THAT upon receiving the report of the Licensing section, oral and/or written evidence from the applicant, interested parties and/or responsible authorities, the application be determined as detailed below:

Application:

Application for the Grant of a Street Trading Consent in respect of Out to Lunch, Hurstake Road, Riverside Industrial Estate, Newport

Details:

Monday – Saturday: setting up from 0800 hours to commence trading 0830 hours, end of trading 1600 hours, to be cleared by 1630 hours.

Comments :

A map showing the road restrictions was circulated.

 

Reasons for Decision:

The proposed siting of the Unit was on an important access road used by significant numbers of vehicles, including large goods vehicles.  The Sub Committee concurred with the view of the Highways Department that if a fast food unit was sited there it would attract patrons who would be likely to park in the vicinity illegally.  Such illegal parking would compromise the safety of motorists and pedestrians.  The Sub Committee balanced the safety concerns in relation to motorists and pedestrians against the inconvenience to the applicant and was of the view that no conditions would alleviate those concerns.

 

Resolution:

THAT the grant of a Street Trading Consent be refused and the applicant be refunded his fee in full without any deductions.
