Child Employment


Service Description: Some students will take the opportunity of some part time working and it is important that parents understand the legal position with regard to this. Parents / Carers should be aware that the law regulating the employment / working of young people is quite specific. Employers MUST complete and submit an Application for Child Employment (Form WM8) to the Local Authority for approval before employment can begin. This form can be found on the Council's website to complete and submit on-line or it can be printed and posted. A copy of the employer's risk assessment must also accompany the application. Question: Are the rules for work experience placements different to child employment rules?

Answer: Yes. There are fewer restrictions for work experience placements than for part-time employment. However, by law such placements must be approved by the local Education Authority. On the Isle of Wight schools undertake the approval of placements. As work experience is an educational activity no payment related to a rate per hour must be made to a pupil, but it is permissible to pay certain “out of pocket” expenses. Additionally there is no objection to employers extending the benefits of any employee welfare scheme to work pupils. Any questions regarding your child’s placement should be directed, in the first instance, to his/her school. If your child wishes to continue working after the completion of a work experience placement then he/she would be subject to the normal child employment regulations.
