MINUTES OF A MEETING OF THE REGULATORY APPEALS COMMITTEE HELD AT COUNTY HALL, NEWPORT, ISLE OF WIGHT ON WEDNESDAY 31 OCTOBER 2001 COMMENCING AT 10.00 AM

11. REPORT OF THE STRATEGIC DIRECTOR OF CORPORATE AND ENVIRONMENT SERVICES

(a) The Isle of Wight Council (Various Streets, Gurnard and Northwood, IW) (Traffic Regulation) Order No1 2001
The Strategic Director of Corporate and Environment Services advised members that a proposal to introduce yellow line waiting restrictions had been advertised in September 2001 as part of a package of measures to improve road safety at urban junctions. The comments of the Police were taken into consideration and the local member put his views to the Committee.
(i) Nodes Road - No Waiting at Any Time
One letter of objection had been received relating to Nodes Road on the grounds that the restriction did not go far enough as it did not include proposals for the North/east side of the road opposite the junction of Cranleigh Gardens.
RESOLVED :
THAT the order be implemented as advertised.
(ii) Venner Avenue - No Waiting at Any Time
This restriction had been advised following a letter from the occupier of 63 Venner Avenue who had expressed his concern over difficulties in entering and existing his driveway. One letter of objection had been received on the grounds that the restriction did not go far enough as it did not cover the bend at the western part of the road.
RESOLVED :
THAT the order be implemented as advertised.
(b) Trees at Timber, Undercliff Drive, St Lawrence, Tree Preservation Order No.17 and 26, 2001
The Committee believed that the report raised a number of complex issues and in order to have a full understanding of the facts members felt a site visit would be beneficial.
RESOLVED :
THAT the matter be deferred for a site visit and be reconsidered at the next meeting of the Regulatory Appeals Committee due to be held on 30 November 2001.

12. EXCLUSION OF PUBLIC AND PRESS

RESOLVED :
THAT under Section 100(A)(4) of the Local Government Act 1972 the public and press be excluded from the meeting for the following item of business, namely Minute number 11 on the grounds that there is likely to be disclosure of exempt information as defined in paragraphs 5 and 7 of Part 1 of Schedule 12A of the Act.

13. BUSINESS RATES HARDSHIP RELIEF AND DISCRETIONARY RATE RELIEF

The Strategic Director of Finance and Information advised the Committee that the Council were permitted to grant relief on the grounds of hardship and outlined the circumstances which were required to be shown. The Committee considered each application in turn.

The Committee considered that hardship due to foot and mouth had not been established.
RESOLVED :
THAT relief on grounds of hardship should not be given.
b) 50218171
The Committee considered that hardship due to a loss of trade had not been caused been caused solely by foot and mouth disease.
RESOLVED :
THAT relief on the grounds of hardship should not be given.
