MINUTES OF A MEETING OF THE REGULATORY APPEALS COMMITTEE HELD AT COUNTY HALL, NEWPORT, ISLE OF WIGHT ON FRIDAY 28 SEPTEMBER 2001 COMMENCING AT 10.00 AM

7. ELECTION OF CHAIRMAN FOR THE DAY

Due to the absence of the Chairman and Vice Chairman, it was necessary to elect a Chairman for the day.
RESOLVED :
THAT Mr M Cunningham be elected Chairman for the day.

8. REPORT OF THE DIRECTOR OF ENVIRONMENT SERVICES

(a) Objections to Advertised Traffic Orders - The Isle of Wight Council (Great Preston Road/Gassiot Green, Ryde, IW) (Traffic Regulation) Order No1 2001 and The Isle of Wight Council (Great Preston Road/Gassiot Green, Ryde, IW) (Prohibition of Driving) Order No 1 2001
The Director of Environment Services advised members that a proposal to introduce a prohibition of driving order and yellow line waiting restrictions had been advertised in August 2001 to address a number of road safety issues in Great Preston Road and Gassiot Green. A number of objections had been received including those of the Police. Letters of objection from Oakfield CE Primary Pre School and Holiday Club and Oakfield CE Aided Primary School were circulated at the meeting.
(i) Gassiot Green - No Waiting 08:30 to 09:15 and 14:30 to 15:30, Monday to Friday during school term time.
RESOLVED :
(i) THAT the report be noted.
(ii) THAT further negotiations with the Police, Southern Vectis, the school and local community were to be held with the aim to resolve their objections, but in the event of this being unsuccessful, a public enquiry be established to determine the matter.
(ii) Great Preston Road - No Waiting 08:30 to 09:15 and 14:30 to 15:30, Monday to Friday during school term time.
RESOLVED :
(i) THAT the report be noted.
(ii) THAT further negotiations with Police, Southern Vectis, the school and local community were to be held with the aim to resolve their objections, but in the event of this being unsuccessful, a public enquiry be established to determine the matter.

(b) The Isle of Wight Council (Various Streets, Shanklin, IW) (Traffic Regulation) Order No 2 2001
Members gave consideration to a number of amendments to the yellow line waiting restrictions that had been advertised in July 2001. This followed consultation with the Police to address a number of road safety issues in Shanklin.
(i) Cedar Drive - No Waiting at Any Time
RESOLVED :
THAT the order be implemented as advertised.
(ii) Carter Avenue - No Waiting at Any Time
RESOLVED :
THAT the order be implemented as advertised.
(iii) Carter Avenue - No Waiting at Any Time/No Loading& Unloading at any time
RESOLVED :
THAT the order be implemented as advertised.
(iv) Collingwood Road - No Waiting at Any Time
RESOLVED :
THAT the order be implemented as advertised.

9. EXCLUSION OF PUBLIC AND PRESS

RESOLVED :
THAT under Section 100(A)(4) of the Local Government Act 1972 the public and press be excluded from the meeting for the following item of business, namely Minute number 10 on the grounds that there is likely to be disclosure of exempt information as defined in paragraphs 5 and 7 of Part 1 of Schedule 12A of the Act.

10. BUSINESS RATES HARDSHIP RELIEF AND DISCRETIONARY RATE RELIEF

The Director of Finance and Information advised the Committee that the Council were permitted to grant discretionary rate relief and on the grounds of hardship and outlined the circumstances which were required to be shown. The Committee considered each application in turn.
a) 70103969 - Application for Hardship Relief
The Committee considered that hardship due to a loss of trade had not been caused been caused solely by foot and mouth disease.
RESOLVED :
THAT relief on the grounds of hardship should not be given.
b) 70088084 - Application for Hardship Relief
The Committee considered that hardship due to a loss of trade had not been caused been caused solely by foot and mouth disease.
RESOLVED :
THAT relief on the grounds of hardship should not be given.
c) 70102435 - Application for Discretionary Relief
The Committee believed that insufficient evidence had been given to establish hardship.
RESOLVED :
THAT the matter be deferred until more detailed accounts had been received in order to show a full years trading.
