Title:                OBJECTIONS TO ADVERTISED TRAFFIC ORDERS

 

REPORT OF THE STRATEGIC DIRECTOR OF CORPORATE AND ENVIRONMENT SERVICES

 

 

1.         THE ISLE OF WIGHT COUNCIL (VARIOUS ROADS, IW) (PROHIBITION OF PUBLIC SERVICE VEHICLES) ORDER No 1 2002

 

SUMMARY

 

An order to introduce a prohibition of Public Service Vehicles was advertised in February 2002 and the following representations have been received.

 

REPRESENTATIONS

 

A total of 4 letters of objection have been received. One of which is from the proprietor of Adgestone Vineyard, who although is in support of a restriction for full size coaches is concerned that the proposal will restrict access for wine tasting tours which contain parties of between 20-25 people, who use mini buses.

 

One further objection has been received from a local tour operator who feels that the existing 6’6” restriction is adequate to prevent large vehicles using the narrow country lanes. Furthermore the proposal will prevent access with a small public service vehicle.

 

Two further objections refer to the restriction for access for 16 seater mini buses.

 

EVALUATION

 

For some time there have been a number of concerns regarding the use of the narrow lanes in the area by full size coaches visiting Adgestone Vineyard. This has resulted in such vehicles being physically stuck, causing damage to both the vehicle and the banks and verges adjacent to the carriageway. In addition such activities cause considerable anxiety for both the coach passengers and the local residents.

 

As a result, and after consultation with Brading Town Council, the local member, and the police it was recommended that a restriction for public service vehicles be advertised in an attempt to clarify to coach drivers the unsuitability of the lengths of roads contained within the order.

 

By definition a public service vehicle is “ a motor vehicle adapted to carry more than eight passengers, being used for hire or reward”.

 

A Mini Bus is “a motor vehicle which is constructed or adapted to carry more than 8 but not more than 16 seated passengers in addition to the driver”

 

The existing proposal would prevent access for all such vehicles including 16 seater mini buses.

 

In light of the objections received I consider it appropriate to recommend that the Order be implemented, as advertised, but with the following additional exemption.

 

“Nothing in Article 2 of this Order shall apply so as to prevent any person from causing any Mini Bus to proceed in the lengths of road specified in the Schedule to this Order.”

 

POLICE COMMENTS

 

Hampshire Constabulary has not provided any written comment on the matter.

 

RECOMMENDATION

 

That the Order be implemented as advertised with the following additional exemption:

 

“ Nothing in Article 2 of this Order shall apply so as to prevent any person from causing any Mini Bus to proceed in the lengths of road specified in the Schedule to this Order”
