MINUTES OF A MEETING OF THE REGULATORY APPEALS COMMITTEE HELD AT COUNTY HALL, NEWPORT, ISLE OF WIGHT ON TUESDAY 23 SEPTEMBER 2003 COMMENCING AT 10.00AM

12. DECLARATIONS OF INTEREST

There were no interests received at this stage.

13. TREE PRESERVATION ORDER 2003/6 AT TIMBER, UNDERCLIFF DRIVE, VENTNOR

The Chairman welcomed the parties to the meeting and introduced the members of the Committee.

The Chairman then advised those present, that the meeting would be adjourned in order for the Committee to receive legal advice concerning some papers that had been received relating to the service of the Order.

Upon reconvening in public, the Committee announced their decision. The Committee had been presented with affidavits that suggested that an adjacent landowner may not have been served with the prescribed papers. In order for the service of documentation to be investigated by the Countryside Officer, the matter would be adjourned. The Committee also urged the Countryside Officer to ensure the continued protection of the trees in the interim.

RESOLVED :

THAT the matter be deferred so that service of the original papers could be investigated
