MINUTES OF A MEETING OF THE REGULATORY APPEALS COMMITTEE HELD AT COUNTY HALL, NEWPORT, ISLE OF WIGHT ON 19 MAY 2003 COMMENCING AT 10.00 AM

1.                  DECLARATIONS OF INTEREST

 

At 10.05 Mr Mundy declared a personal interest in Minute 2(b) as one of the Directors of the Council’s consultants was known to him.

 

2.                  REPORTS OF THE CHIEF EXECUTIVE OFFICER AND STRATEGIC DIRECTOR OF ENVIRONMENT SERVICES

 

(a)         St Anne’s, Augusta Road, Ryde – Tree Preservation Order No 26, 2002

 

The Committee were informed that although the landowner was present following a misunderstanding his lawyer was unable to be present and the landowner requested that this item be deferred to another meeting so that his lawyer could  be present to make representations on his behalf.

 

RESOLVED :

 

THAT this item be deferred to another meeting to enable the landowner’s lawyer to be present.

 

(b)         Coburg Court and Cockerell Rise, Victoria Grove, East Cowes – Tree Preservation Order No 24, 2002

 

The Committee received a report form the Chief Executive Officer and Strategic Director of Environment Services on the history and current situation regarding the proposal to confirm the above Tree Preservation Order (TPO) and on the request to remove four trees (number T1, T2, T3 and T4 in the TPO).

 

The Committee had already visited the site and the view of the Councils independent consultants were that the trees in question had not contributed to the structural damage on Coburg Court. It was noted that the consultants engaged by the applicant for the removal of the trees had suggested that they were responsible. The Committee considered that, on the basis of the evidence available, the structural damage to the building was likely to have been caused by the broken drain, not the trees.

 

Neither the applicant, landowners or other interested persons were present.

 

RESOLVED :

 

THAT Tree Preservation Order No 24, 2002, be confirmed without modification and that consent to remove trees number T1, T2, T3 and T4 in the TPO be refused as in the view of the Committee the trees did not contribute to the structural damage of the property and they were an important visual amenity for the street scene.
