TREE PRESERVATION
ORDER TPO/2003/21 - TIMBER, THE UNDERCLIFF DRIVE, VENTNOR
The Chairman welcomed those present to the meeting and introduced the members of the Committee.
With the agreement of the Chairman, the Senior Solicitor acting for the Council read out a short statement. Members were advised that the Council had made Tree Preservation Order 2003/21 because officers believed that the report of the Ombudsman required this action. A legal review of the case prior to confirmation of Tree Preservation Order 2003/21 had established that the making of Tree Preservation Order 2003/06, which was a temporary order, and then Tree Preservation Order 2002/23 had fulfilled that obligation. Therefore, there was no need for a new order as all those trees identified in the new Order were already protected by Tree Preservation Order 2002/23 which had been confirmed on 12 December 2002. Members were informed that the Council would reassess Tree Preservation Order 2002/23 and would consider whether or not a variation order would be necessary.
Confirmation was given that the trees that were to be protected by Tree Preservation Order 2003/21 were already protected by previous Orders. Therefore there was no need to confirm Tree Preservation Order 2003/21.
RESOLVED :
THAT Tree Preservation Order 2003/21 would not be confirmed
