The Chairman agreed to an item of urgent business as a decision was needed before the next meeting. The Director of Corporate Services sought to clarify authorisation to commence enforcement action at Merrie Gardens and Scotchells Brook regarding the unacceptable use for a vehicle and trailer park and associated effect on amenities.

Five further letters of objection had been received.

Refused contrary to officer recommendation and enforcement action was authorised for the following reasons

1. The outbuilding, by reason of its position, size, design and external appearance, is an intrusive development out of scale and character with the prevailing pattern of development in the locality and has a serious and adverse effect on the amenities enjoyed by the occupants of neighbouring properties and is therefore contrary to Policy D1 of this Council's Unitary Development Plan.

2. The proposal, by reason of the lack of number and nature of car parking spaces provided, has led to an unsatisfactory development of the site with inadequate car parking arrangements and so would be likely to give rise to additional indiscriminate kerbside car parking at and within the vicinity of the site which in turn would be detrimental to the safety of both vehicles and pedestrians and would also be contrary to Policy TR7 of this Council's Unitary Development Plan.

3. The proposal would involve the loss of a satisfactory single family dwelling house of a size which the Council considers to be inappropriate for the subdivision into more than one dwelling and so would have an adverse effect on the amenity of the area generally and on the amenities enjoyed by occupants of neighbouring properties in particular by reason of increased activity, noise and general disturbance and would also be contrary to Policy D1 of this Council's Unitary Development Plan.

(ii) Part IV - Items Other Than Current Issues
(a) TCP/19196Z - Unauthorised construction of storage shed at 134 Binstead Lodge Road, Binstead and unauthorised erection of boundary enclosure forward of the original building line on an "open plan" estate
Consideration was given as to whether or not the circumstances justified the service of an enforcement notice that required the removal of the storage shed and boundary enclosure from the land.
RESOLVED :
THAT no further action be taken in respect of the storage shed and realigned boundary enclosure.
(b) TCP/22128A - Surface water balancing pond, including inlet and outlet structures, land north of Mountbatten Drive, Newport, Isle of Wight
Members were updated on negotiations since the consideration of the report in March 2001 and consideration was given as to whether or not a Section 106 Agreement was now necessary in light of the developer's agreement to make a contribution of �20,000 and enter into an agreement with the Highway Authority under s111 of the Local Government Act 1972 for the future maintenance for the balancing pond.
RESOLVED :
THAT the decision be deferred until after a meeting with the Environment Agency and the matter be brought back to the next meeting of the Development Control Committee.
(c) U/306/01 - 27 plots, land at Alverstone Marshes, on south side of cycle track approximately 550 metres, west of Golf Links Road, Sandown
Members considered whether or not the Local Planning Authority should withdraw certain permitted development rights relating to the above land through the imposition of an Article 4(1) Direction. The Countryside Section Support the application.
RESOLVED :
THAT the necessary measures be proceeded with to create an Article 4(1) Direction removing the permitted development rights as set out under Part 2, Part 4 and Part 5 of the Town and Town and Country Planning (General Permitted Development) Order 1995.

44. URGENT BUSINESS - TEST INSTALLATION OF WIND POWERED GENERATORS AT ST CATHERINE'S LIGHTHOUSE

The Chairman agreed to an item of urgent business relating to the test installation of wind powered generators at St Catherines Lighthouse as a decision was required before the next meeting.
The Strategic Director circulated a report indicating the wish of Trinity House Lighthouse Service to test wind turbines on a number of lighthouses around the country during the winter of 2001/2002. Members noted that such work was deemed permitted development. However where St Catherines Lighthouse was a Grade II Listed building, even taking into account the temporary nature of the works proposed, Listed Building Consent would be required.
The Committee noted that it would be advantageous to inspect the test installation should an application be made at a later date for a permanent installation on the Listed Building.
RESOLVED :
THAT Members agree to the dispensation and allow the temporary installation of wind powered generators subject to :
Details of the installation being submitted to the Strategic Director of Corporate and Environmental Services; and
The removal of any structure/equipment by the 30 April 2002.

45. REPORT OF THE STRATEGIC DIRECTOR OF CORPORATE AND ENVIRONMENT SERVICES

(a) To consider any items deferred from the last meeting of the Committee and the Site Inspection meeting.
TCP/22370/A - Outline for residential development of 94 units (houses, flats, bungalows) accessed off Sherbourne Avenue, (revised plans and additional information - readvertised application) east of Winston Close/north of Grange Avenue existing industrial site south of Sherbourne Avenue, Ryde, Isle of Wight
Members were reminded that the application had been considered at the Development Control Committee meeting held on 16 October 2001. At that meeting it was decided a site inspection should take place, but determination of the application would not be considered until the next full Development Control Committee to be held on 6 November 2001. The site inspection was carried out on 26 October 2001.
Members were advised that since the site visit had taken place the site layout had been revised, although it was not substantially different from the original submission. There had been a number of late representations received and members attention was drawn in particular to the comments of the Highways Engineer, Tree and Landscape Officer, Applicant's agent, Council's Education Officer and the Spokesperson for Economic Development, European and Regional Issues. Two further letters of objection had also been received. A letter from the Chairman of the Isle of Wight Partnership was read out.
Members discussed various aspects of the application including mixed use of the site, the impact of the development on local schools, a play area, road infrastructure, starter units, affordable housing, sewer works and the water drainage system. The Housing Manager outlined the level of homelessness in the Ryde, Binstead and Wootton areas.
RESOLVED :
(i) THAT the application be approved, (subject to the conclusion of a planning obligation to co-ordinate the residential development of the site with light industrial development approval under TCP.21105Z (plot 2, Westridge Business Park, Cothey Way) in accordance with a schedule to be agreed with the Local Planning Authority) and make provision for a commuted payment if an agreed sum towards provision of a play area within close proximity to the site. Such agreement shall provide for the timing of such payment and the programme for the provision of the play area.
(ii) THAT a letter be sent to the applicants as follows :
Your attention is drawn to the possible presence of asbestos within these existing industrial buildings and its removal will need to be carried out by a Health and Safety Executive approved contractor under the Control of Asbestos At Work Regulations 1987 and The Asbestos (Licensing) Regulations 1983 (as amended).
(iii) THAT condition 7 to change the first 20% to 50%.
(iv) THAT an appropriate landscaping condition to be added.
(v) THAT the appropriate Highway conditions to include a Grampian condition for the off site works.

Members were updated on negotiations undertaken since the consideration of the report in March 2001 and consideration was given as to whether the adoption of the pond as part of the drainage scheme in the light of the offer from the developers of �20,000 to cover future maintenance liabilities was appropriate a Section 106 Agreement was now necessary in light of the proposal to enter into an agreement with the Highway Engineer.
Members felt that even with the offer, there should be no liability in the long term or short term for the Council.

48. REPORT OF THE STRATEGIC DIRECTOR OF CORPORATE AND ENVIRONMENT SERVICES

The Strategic Director of Corporate and Environment Services highlighted all the changes that had been made to the original report on the planning applications for the redevelopment of the Isle of Wight College and retail development on land north of the Isle of Wight College and three sites fronting Riverway, which had been previously circulated to Members.
The Chairman asked members if they wanted more time to look at the changes that had been made before the discussion continued. It was proposed that the meeting be adjourned to another date to give members time to digest the extra material that had been circulated, but after a vote had been taken it was decided to proceed with the matters.
The Strategic Director reported on representations that had been received since the report had been distributed, these included :
A letter from the agents acting for B & Q
A letter from the agents acting for Fairholme Ltd
A letter from the agents acting for Wakes Carpets
Copies of these letters were circulated and the Strategic Director responded to the points raised. Members were also advised that the scheme for Pan had been withdrawn.
The Policy basis that had been used for determining the four retail proposals was PPG 6 and Policy R4 of the Unitary Development Plan. Counsels advice was referred to and the Council's consultant, Drivas Jonas, was in attendance.
Members discussed various aspects of the report which included the road infrastructure, a new SCOOT traffic signal system for Coppins Bridge, further expansion for the College, the provision of buses for the B & Q site and the College, secure fixing for motorbikes, cycle and pedestrian routes. Members were also advised that if any of the retail applications were approved they would need to be referred to the Secretary of State.
(a) TCP/21378L - Outline for nursery, sports hall, learning resource centre, entrance canopy, 6 mobile classrooms and access roads, Isle of Wight College, Dodnor Lane, Newport
RESOLVED :
(i) THAT the application be approved, (Section 106 Agreement re submission, implementation and monitoring of a green travel plan), subject to an additional condition restricting the consent for the temporary classrooms to five years, or completion of the redevelopment, whichever is the sooner.
(ii) THAT Condition 13 be replaced with the following :
Before any part of the development authorised by this consent is brought into use, facilities shall be provided within the site for the secure parking of motorcycles in accordance with scheme to be agreed in advance with the Local Planning Authority and such provision as is made shall be retained thereafter.
(b) TCP/21378M - Demolition of nos 24-30 (evens) Dodnor Way, College Block B and part Block E; proposed non-food retail warehouse with garden and builders' yard, car parking and servicing arrangements, replacement college car park, new internal access road and new access to Medina Way, Isle of Wight College, Dodnor Lane, Newport
RESOLVED :
(i) THAT the application be approved subject to reference to the Secretary of State. A Section 106 Agreement re contributions of �20,000 to Public Art and �165,000 for the purpose of improving public transport provision in the area, to be payable on commencement of the works approved for the construction of the store.
(ii) THAT a tripartite Section 106 Agreement between the Isle of Wight Council, B & Q and the Isle of Wight College be concluded prior to the issue of the decision notice to prevent the commencement of trading from the store until the full purchase price has been paid to the Isle of Wight College and requiring the Isle of Wight College to undertake that those funds will be used to undertake the redevelopment proposals shown in the submitted drawings and approved under TCP/21378L/P1193/00.
(iii) THAT Condition 12 to be replaced with the following :
The retail areas hereby approved shall be utilised for the sale of DIY goods, equipment and material for the repairs, maintenance and improvement of the home, garden and motor vehicles, floor coverings and building materials only, unless the prior consent of the Local Planning Authority is obtained in writing.
