Members considered whether circumstances justified an extension to the compliance period of the enforcement notice which related to the removal of a coach, motor vehicles and storage structures from the land and gave consideration to the retention of one shed on the land.

 

RESOLVED :

 

                      (a)       THAT the appellants be advised that the Council will extend the period of time for them to comply with the requirements of the notice to 1 May 2002 on the understanding that they withdrawn their appeal forthwith.

 

                      (b)       THAT the appellants be advised that the Council is not prepared to accept the retention of the shed without its need being tested through submission of a planning application.

 

71.      URGENT BUSINESS - UNAUTHORISED ALTERATIONS TO LISTED STRUCTURE, WESTOVER PARK BRIDGE, WESTOVER PARK, CALBOURNE


Members were advised that the matter had been scheduled to be considered at the meeting of the Development Control Committee on 29 January 2002, but at the request of the local member it had been brought forward as an item of urgent business.


Consideration was given as to what action should be taken in respect of an unauthorised metal grill across the centre arch of a bridge which was a listed building. The work had been carried out without the benefit of listed building consent. The local member told the Committee the background to the matter.

 


RESOLVED :

 

THAT a Listed Building Enforcement Notice be served under Section 38 of the Planning (Listed Buildings and Conservation Areas) Act 1990 requiring the removal of the grill under the bridge from the listed structure and the necessary repair work to be carried out where the grill was affixed to the structure. Allowing 28 days as a period for compliance from the date when the notice takes effect.

74.      URGENT BUSINESS - TCP/2817N - THREE STOREY BUILDING TO PROVIDE RETAIL UNIT AND RESTAURANT ON GROUND FLOOR WITH TOTAL OF TWELVE FLATS ON FIRST AND SECOND FLOORS, 37 PYLE STREET, NEWPORT

 

The Chairman agreed to consideration of an item of urgent business as a decision was required prior to the next meeting. Members were reminded that the application was approved at the meeting of the Development Control Committee on 18 December 2001, subject to a commuted payment by the applicants of £9,000 as a contribution towards the sustainable transport fund, by a Section 106 agreement. This was required under Policy TR16 (appendix G) of the Isle of Wight Unitary Development Plan. The applicant had now questioned the principle of the contribution and suggested a reduction of £3,000. The applicant had submitted a report prepared by consulting engineers which supported this. Members received comments from the Highways Engineer who concurred with the original assessment as not to apply the policies would be inconsistent.

 

RESOLVED :

 

THAT the reduced contribution of £6,000 be not accepted and to continue to require the full payment in accordance with the policy (Policy TR16 Appendix G) of £9,000 and advise the applicant that any reduction in that figure was unacceptable and would result in the application being refused on the basis that the applicant had failed to comply with the relevant policy in terms of contribution to the Council’s sustainable transport fund.

           (a)       Further Training for Members of the Development Control Committee

 

Members were advised of the need for ongoing training for the Development Control Committee. It was anticipated that a Development Day with an outside facilitator would be arranged.

 

RESOLVED :

 

                      (i)        THAT the need for further training for Members of the Development Control Committee be agreed with the next session focussing on matters of propriety using an outside facilitator.

 

                      (ii)       THAT an outside facilitator be used to attend a meeting, interview Members/officers and facilitate a development day be agreed.

To Consider any Items Deferred from the Last Meeting of the Committee and the Site Inspection Meeting

 

Members were advised that as the Committee was not quorate for the site visit part of the meeting held on 18 January 2002, no decisions could be made on the two sites that were involved. Clarification had been sought on the procedures that should be adopted in such circumstances the Committee were advised of what action was open to them.

 

One or both applications could be considered afresh and the previous decision for a site visit be rescinded, or one or both sites be included as part of the site inspections due to take place on 8 February 2002.

Reasons:

The application was refused contrary to officers recommendation as members felt the scale and mass of the building were too large and dominant, bearing in mind the nature of the surrounding area and that additional traffic generation from the number of flats proposed would be likely to cause hazard to users of the adjoining highways. The proposal would adversely affect the character of the surrounding area and the amenities of nearby residents. It would therefore be contrary to policies G4, G10, D1, D2 and TR7 of the Isle of Wight Unitary Development Plan.
