ISLE OF WIGHT COUNCIL (UNDERCLIFF DRIVE HIGHWAY

REALIGNMENT) COMPULSORY PURCHASE ORDER 2006

 

The Highways Act 1980

and the Acquisition of Land Act 1981

 

 

The Isle of Wight Council (in this order called “the acquiring authority”) makes the following order

 

  1. Subject to the provisions of this order, the acquiring authority is under sections 239, 240, 246 and 250 of the Highways Act 1980 hereby authorised to purchase compulsorily the land and the new rights over the land described in paragraph 2 and 3 for the purposes of:-

(i)            the improvement/construction of a highway along the route of the A3055 Undercliff Drive from a point west of Orchard Close to a point east of The Spinnaker;

(ii)     use by the acquiring authority in connection with the construction and improvement of a highway as aforesaid; and

(iii)    mitigating the adverse effect which the existence or use of the highway proposed to be constructed or improved, as mentioned in Article 1(i) of this Order, will have on the surroundings thereof.

 

2.         The land authorised to be purchased compulsorily under this Order is the land described in the Schedule 1A and which is delineated and shown hatched in red on the map prepared in duplicate, sealed with the common seal of the acquiring authority and marked “Map referred to in The Isle of Wight Council (Undercliff Drive Highway Realignment) Compulsory Purchase Order 2006”.

 

3.         The new rights to be purchased compulsorily over land under this Order are described in Schedule 1B and the land is delineated and shown cross-hatched in green on the said map.
