MINUTES OF A MEETING OF THE RESOURCES SELECT COMMITTEE HELD AT COUNTY HALL, NEWPORT, ISLE OF WIGHT ON THURSDAY, 29 AUGUST 2002 COMMENCING AT 2.00 PM

 27.      MINUTES


Members considered that the recommendation contained in Minute 23 relating to the scrutiny session on second homes was not an accurate reflection of the meeting. This would be clarified and the minutes would be submitted for confirmation to the next meeting.


RESOLVED :

 

THAT confirmation of the Minutes of the meeting held on 21 August 2002 be deferred to the next meeting.

 

28.      DECLARATIONS OF INTEREST


Mr V J Morey indicated that as a Member of the Development Control Committee he would take part in the debate but would not consider the matter at Development Control Committee.

 

29.      CALL IN OF EXECUTIVE MINUTE 85 A - PRESTWOOD GRANGE FARM, RYDE


A Member of the Committee outlined his reasons for calling in the decision of the Executive taken on 13 August 2002 regarding Prestwood Grange Farm, Ryde. Members involved in the call in considered that the decision had been taken in contravention to the budgetary framework of the Council. The call in considered that the decision of the Executive to undertake a discontinuance order would have significant financial implications on the Council in addition to Officer time and seeking Counsels opinion.


During the debate, it was considered that the Select Committee would need to be advised of current negotiations and legal implications, relating to this site and it would be appropriate to exclude the public and press. It was therefore


RESOLVED :

 

                       THAT under Section 100(A)(4) of the Local Government Act 1972 the public and press be excluded from the meeting for the following item of business, namely Minute 29 , on the grounds that there was likely to be disclosure of exempt information as defined in Paragraphs 7 and 8 of Part 1 of Schedule 12A of the Act.


Members were advised on the latest position regarding planning issues connected with this site.


The Select Committee invited Mr McDowall, together with his representatives, back into the meeting to confirm certain details.


During these discussions it was suggested that no further action be taken by the Council until further consultation with the landowner had taken place


Mr McDowall and representatives then left the meeting room


The Select Committee then debated the issues further in the light of all the details received.


RESOLVED TO RECOMMEND TO EXECUTIVE :

 

           (a)       THAT it re-considers the previous decision in relation to the discontinuance order in the light of new information that has come to light in respect of Prestwood Grange Farm

 

           (b)       The Chairman be allowed to brief the Executive concerning the deliberations of the Select Committee regarding this matter.
