THAT the Minutes of the meeting held on 27 September 2002 be confirmed.

Interests were declared in the following matters :


Mr A A Taylor declared a personal and prejudicial interest (as a family member carries out works for the applicant) in Minute 67(b) - The Albion Hotel, Freshwater Bay, and was not present during the discussion and voting thereon.

 

67.      REPORT OF THE STRATEGIC DIRECTOR OF CORPORATE AND ENVIRONMENT SERVICES

 

           (a)       POSITION OF CHAIRMAN

 

Due to the Chairman having declared a personal and prejudicial interest in the following matter and therefore vacating the Chair it was :

 

RESOLVED :

 

THAT Mr J F Howe be elected Chairman for the following item.

 

           (b)       TCP/08200/X - Demolition of single and 2 storey building at northern end of hotel; construction of 3 storey extension to provide 15 bedrooms and bathroom suites; new entrance and associated office accommodation; alterations to improve existing bedrooms at 1st floor level, The Albion Hotel, Freshwater Bay, Isle of Wight

 

Members were reminded that the application had been considered at the Development Control Committee meeting held on 17 September 2002. At that meeting it was decided to defer the application so that Officers could negotiate with the applicant’s agent in order to achieve a scheme more in keeping with the site.

 

A meeting had subsequently been held and was attended by both the applicant and his agent who had requested that the application be determined in the submitted form.

 

A supporting letter from the applicant’s agent was circulated.

 

Members considered the design implications of the proposal in relation to the economic, employment and tourist benefits of the scheme to the Island generally and Freshwater in particular. In this particular case, it was decided that although no design improvements had been obtained since the earlier deferral, the benefits of the scheme outweighed any aesthetic considerations and therefore the application should be approved, with appropriate conditions.

 

RESOLVED :

 

THAT the application be approved contrary to officer recommendation, appropriate conditions to be added.


Mr J F Howe vacated the Chair and the Chairman re-entered the room and resumed the Chair.

The reason for Condition 1 should be as follows :

Members recognised that the permanent loss of a residential unit on upper floors in Ventnor town centre would be contrary to Policies H8 and R8 of the Isle of Wight Unitary Development Plan, but also that the proposed educational use of the upper floors of the property had the potential to benefit the Local Community. Therefore, notwithstanding the officer recommendation to refuse the application, members considered it would, in this particular case, be appropriate to grant temporary consent for 5 years and personal to Island Volunteers.

           (ii)       Part IV - Items Other Than Current Issues

 

                       (a)       TCP/1081/V - Unauthorised erection of four advertisement boards, Hazel Green Holiday Village, New Road, Wootton

 

The Committee was advised that during June 2001 a report had been received alleging that four large advertisements had been erected at Hazel Green Holiday Village, New Road, Wootton. The Council’s Enforcement Officer met with the manager of the site and explained that the adverts would require consent. In August 2001 a letter with the relevant fee arrived, but there was no application enclosed. Members considered whether the circumstances justified the service of an Enforcement Notice that required the removal of the adverts.

 

RESOLVED :

 

                                  (i)        THAT the operator be advised that the continued display of the signs in the absence of any formal consent was illegal and could result in a prosecution.

 

                                  (ii)       THAT the Local Planning Authority, expressed its frustration that the operator had failed to remedy the breach but given the circumstances, had decided not to take the matter further.

 

                       (b)       TCP/20059J - Repair works to barn, Fair Oaks Farm, Lower Woodside Road, Wootton

 

Members were reminded that the site had been the subject of a report on 14 May 2002. Consideration was given as to whether the degree of works which the landowner had considered to be a repair to a building had resulted in its reconstruction to the degree that the formal consent of the Local Planning Authority should have been obtained.

 

RESOLVED :

 

THAT the information put forward by the landowner be noted and on balance resolve to accept the interpretation that the works undertaken to the building could be accepted as a repair and as such, to withdraw the advice that the works required formal consent of the Local Planning Authority.

 

                       (c)       TCP(E)22046A - Unauthorised siting of mobile home for residential purposes on part OS 7982, Westside Lane, Chale, Isle of Wight

 

Consideration was given as to the service of an Enforcement Notice which required the cessation of residential use of the mobile home, if this had commenced, and removal of the mobile home from the land.

 

RESOLVED :

 

THAT an Enforcement Notice be served requiring the removal of the mobile home from the land – time for compliance three months.

 


                       (d)       E/22305/D, E & F - Enforcement notices relating to siting of mobile home for residential use, fencing panels and timber shed at The Sun Inn, Hulverstone

 

Members considered whether to extend the period of compliance for the cessation of the residential use of the mobile home and the dismantling and removal of all the items from the site.

 

RESOLVED :

 

THAT the appellant be advised that the Council was prepared to extend the period of compliance with the requirements of the Notices to expire on 1 August 2003 on the condition that all the appeals are withdrawn forthwith.
