November 2003 be confirmed.

was given to the following item in the report of the Head of Planning Services.

THAT the two applications be determined as detailed below :
The reasons for the resolutions made in accordance with Officer recommendation are given in the Planning report. Where resolutions are made contrary to Officer recommendation the reasons for doing so are contained in the minutes.

Members indicated that
whilst the dormer windows might be acceptable the rest of the scheme was not
appropriate for reasons of overlooking nearby properties. |
Decisions: |
1.
That
the application should be refused permission on the following grounds: The raised decking and summerhouse is an intrusive structure by reason
of the elevated position above ground level, giving rise to overlooking of
adjacent properties, causing a loss of privacy and amenity for the occupiers
of those properties, and is therefore contrary to Policy S6 and Policy D1 of
the IW Unitary Development Plan. 2.
That
an Enforcement Notice should be served, requiring the raised decking to be
dismantled and removed from the site, with the summerhouse returned to its
original position or another position within the rear garden area to be
agreed with the Local Planning Authority, allowing a period of compliance of
three months. 3.
That
the applicant be formally notified that an application for the retention of
the dormer window is, subject to third party representations, likely to be
looked upon favorably. |

At the request of Mr Effemey a copy of an extract from the Isle of Wight
County Press from 2000 detailing land slip problems at the other end of Cliff
Road was circulated by a local members. |
Comments: |
Local members spoke raising issues of the scale of
the building and land stability issues. It was noted that the Council’s consultants and
officers had advised that the proposed engineering works would overcome any
land stability issues. Members consider that the mass and scale of the proposed development
was inappropriate for the area. |
Decision: |
That the
application be refused permission on the following grounds: The proposed development, by reason of its scale, mass, height and
width would have an intrusive and over-dominant effect when viewed from both
Baring Road and Cliff Road and would therefore be out of character with the
general pattern of development in the area, contrary to Policy D1(a), (c),
(g) and D2(a) of the Isle of Wight Unitary Development Plan. |
