Other Matters Not Relating To Current Planning
Applications
(i) TCP(E)18550/E Unauthorised siting of a
second satellite dish on a block of flats below 15 metres in height, 33 Pier
Street, Ventnor
Consideration
was given to whether circumstances justified the service of an Enforcement
Notice requiring the removal of the second satellite dish from the rear of 33
Pier Street, Ventnor.
RESOLVED
:
THAT
no further action to be taken in respect of the satellite dish.
TCP/20443E and TCP/9702 Two unauthorised mobile
homes being used for residential purposes at Hawthorn Manor Farm, Chale Green,
and one mobile home and one caravan being used for residential purposes at
Sheep Lane Farm, Chale
Consideration was given to determine
whether in the light of changed circumstances additional enforcement action
should be taken seeking the cessation of residential use of two mobile homes at
Hawthorn Manor Farm, and one mobile home and a caravan at Sheep Lane Farm, and
their removal from the land. Members
were also asked to consider an extra point of enforcement in regards to any
additional caravan or mobile homes on “all”, in amendment to “both” of these
sites
RESOLVED :
THAT the following recommendations be authorised:
1. To reaffirm Committee decision of 23 April
2002, to take enforcement action against remaining mobile home/caravans which
were mentioned in 2002 report.
To authorise enforcement action requiring the
cessation of use of the two mobile homes at Hawthorn Manor Farm and the
cessation of residential use of the caravan and mobile home at Sheep Lane Farm
and removal of the caravan and mobile homes from the respective farms. Time for compliance, six months from when
the notice takes effect.
To authorise enforcement action in respect of
cessation of residential use and removal (where appropriate) of any additional
caravan or mobile home from one or all properties as subsequent investigations
may be necessary beyond those already authorised by this and previous reports.
(c) Urgent Buisness
E/21249/G Enforcement action in respect of Medham
Village, Medham Farm Lane, off Newport Road, Northwood
Consideration was given to the developer’s offer of
withdrawing their appeal against an Enforcement Notice if the Council extends
the compliance period from three to twelve months. Members noted the additional representations that had been
received from the Medham Village Residents Committee along with a letter from
the local Member, which was read out.
The Committee were also asked to consider authorisation of a second
recommendation in regard to compliance of the Enforcement notice, alongside the
recommendation in the report.
RESOLVED :
THAT
as recommended:
1.
In the
light of the additional information to agree to extend the compliance period of
the Enforcement Notice from three months to twelve months on the basis that the
developer withdraws his appeal.
2.
That the developer be advised that the Local Planning Authority will
monitor the site over the compliance period and that it will expect full
compliance within the allocated time with a failure to lead to consideration of
action through the Magistrates’ Court.
(d)
Schedule of Appeals
The Schedule of Appeals that had been lodged and decisions made was received.
