TCP/21907/E – P/01220/03 Single storey building to provide bar & dining area with ancillary kitchen/toilet facilities/implement store, Chale Bay Farm, Military Road, Chale, Ventnor.
The development hereby permitted shall be begun before the expiration of
5 years from the date of this permission.
Reason: To comply with Section 91 of the Town and Country Planning Act
1990.
Construction of the building hereby permitted shall not commence until a
schedule of all materials and finishes to be used for the external roofing and
walls of the same has been submitted to and approved in writing by the Local
Planning Authority. Thereafter only
such approved materials and finishes shall be used in carrying out the
development.
Reason: To safeguard the amenities
of the locality and to comply with Policy D1 (Standards of Design) of the IW
Unitary Development Plan.
No development shall take place until samples of the materials to be
used in the construction of the external surfaces of the development hereby
permitted have been submitted to and approved in writing by the Local Planning
Authority. Development shall be carried
out in accordance with the approved details.
Reason: In the interests of the
amenities of the area and to comply with Policy D1 (Standards of Design) of the
IW Unitary Development Plan.
Details of the means of extraction of fumes and smells from the premises
shall be submitted to and approved by the Local Planning Authority before the
development hereby approved commences on site.
Reason: In the interests of the
amenities of the adjoining residential property and to comply with Policies P1
(Pollution) and D1 (Standards of Design) of the IW Unitary Development Plan.
The means of extraction of fumes and smells from the premises as
required by Condition 4 of this consent shall be installed before the use is
commenced, and thereafter effectively operated for as long as the use
continues.
Reason: In the interests of the
amenities of the adjoining residential property and to comply with Policies P1
(Pollution) and D1 (Standards of Design) of the IW Unitary Development Plan.
Prior to any work commencing on site in respect of the approved
development, a scheme for the provision of close circuit television cameras and
lighting within the car park and surrounding the building shall be submitted to
and approved by the Local Planning Authority.
Thereafter, the lighting and close circuit television camera shall be
installed/erected and thereafter retained and maintained strictly in accordance
with the approved details and no further such equipment shall be
installed/erected without the prior written consent of the Local Planning
Authority.
Reason: To reduce the opportunities
for crime and to minimise potential light pollution in the interests of the
amenities and character of the area and to comply with policies D11 (Crime and
Disorder), D14 (Light Spillage), C1 (Protection of Landscape Character) and C2
(Areas of Outstanding Natural Beauty) of the Isle of Wight Unitary Development
Plan.
Prior to any work commencing on site, full details of the lighting to be installed pursuant to condition no. 4, together with any measures to minimise light spillage to areas outside the site and in particular skyward, shall be submitted to and approved by the Local Planning Authority. Thereafter, the lighting shall be installed and retained and maintained strictly in accordance with the approved details.
Reason: In the interests of the amenities and character of the locality and to comply with policies D14 (Light Spillage), C1 (Protection of Landscape Character) and C2 (Areas of Outstanding Natural Beauty) of the Isle of Wight Unitary Development Plan.
The lighting to be installed/erected pursuant to condition no. 4 shall only be operated when the pub/restaurant is open to members of the general public and at no other time without the prior written consent of the Local Planning Authority.
Reason: In the interests of the amenities and character of the locality and to comply with policies D14 (Light Spillage), C1 (Protection of Landscape Character) and C2 (Areas of Outstanding Natural Beauty) of the Isle of Wight Unitary Development Plan.
In the event that the stability of the building is threatened by cliff recession, the structure shall be demolished and all materials, including foundations shall be permanently removed from the site in accordance with a timescale to be agreed with the Local Planning Authority.
Reason: To prevent any materials from the development encroaching onto the foreshore and interfering with ecological/coastal process and to comply with policies C9 (Sites of International Importance for Nature Conservation) and C10 (Sites of National Importance for Nature Conservation) of the Isle of Wight Unitary Development Plan.
Prior to work commencing on site, a scheme for the maintenance of existing earthworks/bunds and provision of new earthworks/bunds around the building shall be submitted to and approved by the Local Planning Authority. Thereafter, the earthworks/bunds shall be formed prior to the building being brought into use for the authorised purpose and thereafter retained and maintained in accordance with the approved details.
Reason: To minimise the impact of the development on the landscape character of the area and to comply with policies D1 (Standards of Design), C1 (Protection of Landscape Character) and C2 (Areas of Outstanding Natural Beauty) of the Isle of Wight Unitary Development Plan.
Prior to the building hereby approved being brought into use, the first ten metres of the access drive off Military Road shall be surfaced with a bound material and a centre line applied to the surface in accordance with details to be submitted to and approved by the Local Planning Authority.
Reason: In the interests of highway safety and to comply with Policy TR7 (Highway Considerations for New Development) of the Isle of Wight Unitary Development Plan.
No additional structures or equipment associated with the building hereby approved shall be positioned on site without the prior written consent of the Local Planning Authority.
Reason: In the interests of the amenities and character of the area and to comply with policies C1 (Protection of Landscape Character), C2 (Areas of Outstanding Natural Beauty) and C4 (Heritage Coast) of the Isle of Wight Unitary Development Plan.
No equipment, products or waste associated with the use of the approved
building shall be stacked or stored on the site at any time except within the
buildings or storage areas approved in writing by the Local Planning Authority
for that express purpose.
Reason: In the interests of the visual appearance of the site and the
visual amenities of the surrounding area and to comply with Policy D1
(Standards of Design) of the IW Unitary Development Plan.
The development hereby permitted shall not be commenced until a
specification of the provision to be made for the storage and disposal of
refuse following the commencement of use of the building hereby permitted has
been submitted to and approved in writing by the Local Planning Authority. The
development hereby permitted shall not be brought into use until the
implementation of such provision for refuse has been completed in full
accordance with such an approved specification and such provision shall be
maintained thereafter.
Reason: To safeguard the amenities of the locality and to
comply with Policy D1 (Standards of Design) of the IW Unitary Development Plan.
