RESOLVED :

 

THAT the Minutes of the meeting held on 13 August 2004 be confirmed.

 

36.             DECLARATIONS OF INTEREST

 

Interests were declared in the following matters:

 

Mr C H Lillywhite declared a personal interest in minute 37 (a) (i), item 2 – Land adjoining Journeys End, Westlands, Totland Bay, as he knows the residents of the neighbouring property.

The reasons for the resolutions made in accordance with Officer recommendation are given in the Planning report.  Where resolutions are made contrary to Officer recommendation the reasons for doing so are contained in the minutes.

 

A schedule of additional representations received after the printing of the report was submitted at the beginning of the meeting and were drawn to the attention of Members when considering the application. A note is made to this effect in the minutes.

(b)               Other Matters Not Relating To Current Planning Applications

 

(i)         TCP/4720/R –  Allegation of untidy land at 33 Orchard Road, Shanklin

 

The Chairman had received a letter from the local Member, which she read out to the Committee.

 

Members considered whether the condition of land at the above address justifies the service of a Notice under Section 215 of the Town and Country Planning Act requiring clearance of weeds, brambles and trees from the land, repairs to garden wall and replacement of broken windows because of their adverse effect on the amenities of the area. 

 

RESOLVED :

 

THAT a Notice under Section 215 of the Town & Country Planning Act 1990 be served, requiring:

 

i) The removal of the weeds, brambles and self seeded trees.

ii) The repair of the front garden retaining wall.

iii) The repair of the broken windows.

 

Members also agreed to add in cutting grass and trimming back as appropriate all other vegetation on site.

 

Time period for compliance, 2 months after the Notice takes effect.

 

(ii)               E/2714/J – Dilapidated Condition of Café situated between Tarvic 2 Hotel and St Moritz Hotel, 13-15 Culver Parade, Sandown

 

The Chairman informed the Committee of the comments she had received from the local Member.

 

Members gave consideration to whether circumstances justified the service of a Notice under Section 215 of the Town and Country Planning Act 1990 requiring the Owner of the café to remedy the condition of the building by repainting the external wooden surfaces and to clear the forecourt. 

 

Members were informed that the owner had recently painted the external walls, doors and windows (including the glass) in white, but had failed to repair or replace any rotten timber.  In light of these circumstances Members felt that the serving of the Notice was still justified.

 

RESOLVED :

 

THAT a Notice under Section 215 of the Town & Country Planning Act 1990 be served requiring:

 

(i) Prior to repainting, clean and prepare all external timber surfaces inclusive of walls, window frames, entrance door and signage on the front elevation, removing in the process any flaking paint and replacing any rotten timbers to ensure that all external wooden surfaces are in an appropriate condition for repainting.

 

(ii) Repaint all external wooden surfaces. Walls in the finished colour of magnolia external paint. Window frames, doors and signage in a neutral external primer, undercoated and finished in a coloured gloss paint, which is to contrast with the magnolia.

  

Time period for compliance – 28 days

 

(c)               Schedule of Appeals

 

The Schedule of Appeals that had been lodged and decisions made was received.

 

RESOLVED :

 

THAT the report be noted.

 

38.             URGENT BUSINESS

 

The Chairman agreed to the following item of urgent business, as a decision was needed before the next meeting

 

LAUNCH EVENT TO BE HELD AT MOTOCROSS FACILITY, LAND OPPOSITE GORE CEMETERY, SOUTH EAST OF ARRETON CROSS, DOWNEND ROAD, NEWPORT

 

Members gave consideration on how the Local Planning Authority should respond to a request to use the above site as a launch venue by Honda Europe for their 2005 season. They were informed that no racing or practices would take place but individual Honda team members and journalists would try out bikes and be photographed on them on parts of the course.

 

Members supported the recommendation but wish to add a further comment regarding how the planning application be dealt with as and when it is received, the decision to read as follows:

 

RESOLVED :

 

THAT to note the information outlined above and to invite (without prejudice to the final decision) a planning application to cover this event.”

 

In recognition of the nature of the proposal and the information available at this time, Members indicated that they would support the principle of the event and anticipated a fast-track determination of an application under the delegation procedure
