(ii) Part IV - Items Other Than Current Issues
(a) TCP/5528G - Unauthorised works to listed building at 9 St Thomas Square, Newport
Consideration was given to the service of a listed building Enforcement Notice requiring the removal of seven UPVC windows from the rear elevations of 9 St Thomas Square, Newport which was a Grade II Listed Building and the removal of three freezer units from the flat roof at the rear of the building which had a detrimental effect on the setting of the listed building.
Members were advised that two further applications which sought retrospective planning permission and Listed Building Consent for the canopy at the front of the building, the covering of a yard area at the rear, the insertion of an extraction vent and introduction of a Velux window in the rear roof area had been submitted.
RESOLVED :
(1) THAT Listed Building Enforcement Notice be served requiring the removal of the seven UPVC windows at the rear of 9 St Thomas Square, Newport and their replacement with wooden windows as approved by the Local Planning Authority. Also, to remove the three refrigeration units from the flat roof at the rear of the premises. Time to comply - six months from when the Notice takes effect.
(2) THAT following the return of the Section 330 (Requisition for Information) the Local Planning Authority reviews the situation relating to the progress of the retrospective applications and whether any of those elements should be included in the Enforcement Notice.
(b) TCP/12159C - Unauthorised unit of living accommodation, constructed on land at the rear of Wyvern, Calbourne Road, Carisbrooke

The Local Member had written a letter in support of the recommendation.
Members gave consideration to the service of an Enforcement Notice requiring the cessation of the residential use of a chalet on land to the rear of Wyvern, Calbourne Road, Carisbrooke and the removal of the chalet from the land. A Planning Contravention Notice had been served on the occupants which sought to confirm the facts and circumstances as outlined to officers and it was thought appropriate to await the return of that before commencing any enforcement action.
RESOLVED :
THAT the return of the Planning Contravention Notice be awaited and on the basis that the information supports the facts and circumstances as outlined to officers and which forms the basis of the report, an Enforcement Notice be served requiring the cessation of the residential use and removal of the chalet from the land. Time period for compliance - six months.
(c) TCP/16883B - Construction of decking area to the rear of 20 Leeson Road, Ventnor
Members considered the circumstances relating to the installation of a raised wooden decking area on the rear of a replacement dwelling and based on the information collected, considered whether the installation of the decking area was undertaken by the occupant exercising his householder permitted development rights; or whether the formal consent of the Local Planning Authority was required for the retention of the wooden decking area because the works were undertaken at a time when the permitted development rights could not be exercised because of the condition/use of the new dwelling.
The Committee believed that representations should be made to the Local Government Association, GOSE and the MEP, to highlight the adverse impact on neighbours of permitted development rights in areas such as Ventnor, where there were substantial changes in level between properties.
RESOLVED :
1. THAT Counsel's opinion be accepted as outlined in the report and the applicant be advised together with other interested parties that it was the Local Planning Authority's opinion that the decking area was constructed at a time when the property was considered to be substantially complete and accordingly, was able to benefit from domestic permitted development rights. That on the basis that the size of the decking area was considered to fall below the maximum allowance that the formal consent of the Local Planning Authority was not required for its retention.
2. THAT the formal application submitted by the applicant be closed and the planning fee be reimbursed.
