MINUTES OF A MEETING OF THE DEVELOPMENT CONTROL COMMITTEE – SITE INSPECTIONS HELD AT COUNTY HALL, NEWPORT, ISLE OF WIGHT ON TUESDAY, 21 MAY 2004 COMMENCING AT 11.40 am

6.                  MINUTES

 

RESOLVED :

 

THAT subject to Minute 5 (i) (a) be amended to show that:

 

“Mrs T M Butchers declared a personal interest in Minute 5 (i) (a) – item 4; Land adjacent The Old Barn, Rew Street, Cowes as the Applicant is known to her” and not and 24 Howgate Road, Bembridge as indicated.

 

“Mr J F Howe declared a personal interest in Minute 5 (i) (a) – item 4; Land adjacent The Old Barn, Rew Street, Cowes as the Applicant is known to him” and not and 24 Howgate Road, Bembridge as indicated.

 

“PAPER A1 – TCP/25521 Land North of Redshank Way, Newport, Terrace of 7 houses to be used for holiday purposes and seeking amendment to TCT/14525/S (Additional Information relating to mooring allocation proposed and within existing Marina) (Readvertised Application).”  That condition 3 is amended to read, “received on 12 January 2004” as opposed to “reviewed on 12 January 2004”

 

That the Minutes of the meeting held on 11 May 2004 be confirmed.

Mr C B W Chapman declared a personal interest in minute 8 – item 2, Pt OS Parcel 8700, land at North Fairlee Farm, Fairlee Road, Newport, as the Chairman of the Licensing Panel

 

Mr E Fox declared a personal interest in minute 8 – item 2, Pt OS Parcel 8700, land at North Fairlee Farm, Fairlee Road, Newport, as he is the Portfolio holder for Transport

8.                  URGENT BUSINESS

 

The Chairman agreed to the following item of urgent business, a decision was required before the next meeting.

 

TCP/01870H – Terraced Development of Block of Four Houses and Three Houses, Terrace of Three Houses, Parking and Access Road, Land Abutting Elm Grove and Nine Acres Lane with Access Off St John’s Road, Newport

 

Consideration was given to the amendment of the resolution for the above application, with the amendment being the withdrawal of payment for £9,000 to contribute to educational needs in the area.  Members were informed that the Developer’s felt that the payment requested through a legal agreement for transport infrastructure and open space, were what they anticipated when they purchased the land.  However, the request for £9,000 for education was not, and the Developers would not be able to meet this payment.   

 

The Members were also told that the application would bring a large planning gain by the resurfacing of the car park to the north of the site, which the Developers had arranged separately during the purchase of the land, this has an estimated worth of £20,000.  It was put to the Members that this would more than compensate for the £9,000 education payment.  Member also wanted to ensure that if they did approve the amendment regarding the education payment, all the other conditions including the footpath on the site’s boundary would be upheld.

 

The Chairman requested it be noted that she was concerned and disappointed on the level communication between Council departments regarding this application.

 

RESOLVED :

 

THAT the amendment be approved and the application would be granted planning permission without the requirement for contributions towards education facilities. The requirement for the footpath on the site's boundary along Elm Grove remains along with the other requirements of the 11 May 2004 resolution.

Members were still concerned regarding the size of the building and effect it would have on neighbouring properties

Comment:

Members were minded to extend the compliance period for cessation of use of site and the reinstatement of land to its former condition within twelve months, because of the need to identify and relocate to an alternative location

Decision:

Refusal of planning permission, for the reasons set out in the Part II Register

 

Enforcement action is instigated requiring the cessation of the use of the site as a taxi operating centre, the removal of the portakabin and storage containers and reinstatement of land to its former or an agreed condition, including the removal of the gravel parking area.  Period for compliance - Twelve months.
