The reasons for the resolutions made in accordance with Officer recommendation are given in the Planning report. Where resolutions are made contrary to Officer recommendation the reasons for doing so are contained in the minutes.

 

A schedule of additional representations received after the printing of the report was submitted at the beginning of the meeting and were drawn to the attention of Members when considering the application. A note is made to this effect in the minutes.

The Department of Culture, Media and Sport had confirmed in a telephone call today that Wilmington was ‘not of listable quality’.


Southern Water confirmed that the sewer in Cliff Road did have overloading problems and Appletree Cottage in Eden Road had an anti-flood valve to prevent flooding within the house. This was the only reported property with the risk of internal flooding in the area. However, as long as foul water flows only go to the sewer, increase in flow would be negligible.

           (b)       Pay a commuted sum of £100,000 to the Isle of Wight Council for education facilities.

 

           (c)       Transfer of the area of land, including buildings and open space to the north west to SARA (Sherbourne Avenue Residents Association) on them reaching a charitable status.

 

           (d)       Transfer the area of land to the north west to the Isle of Wight Council for educational use.

Additional reason for refusal as follows :

 

4.        The junction between the proposed access drive and St Pauls View Road is, in the opinion of the Local Planning Authority, inadequate to allow access by a fire appliance and the length of the access is in excess of that which would allow the dwellings to be serviced from an appropriate water supply source or a fire appliance and therefore the proposal is contrary to Policy U12 (Water Supply for Fire Fighting Purposes) of the Isle of Wight Unitary Development Plan.”

2.        THAT a local forum be established with a view to all interested parties meeting at the earliest opportunity with the objective of overcoming the present difficulties on a proactive basis by agreeing changes to operational practice which may in itself involve the submission of a further planning application(s).

 

3.        THAT a decision on enforcement action be deferred to the meeting of the Development Control Committee due to be held on 1 July 2003, at that time there may have been a decision on the village green.

                      (ii)       Part IV - Items Other Than Current Issues

 

TCP/10524/A - Unauthorised Alterations to Open up Vehicular Access, Land Adjacent 22 Howgate Road, Bembridge

 

Members gave consideration as to whether the circumstances justified the service of an enforcement notice which required the closure of the vehicular access and the reinstatement of the land to its original condition.

 

RESOLVED :

 

THAT an Enforcement Notice be served requiring the closure of the vehicular access and the reinstatement of the ground back to its original levels. Time for compliance - one month.

 

           (b)       Schedule of Appeals

 

The Schedule of Appeals that had been lodged and decisions made was received.

 

RESOLVED :

 

THAT the report be noted.

 

13.      URGENT BUSINESS


The Chairman agreed to two items of urgent business as a decision was needed on both items before the next meeting.

 

           (a)       TCP/19636/E DEMOLITION OF GARAGE; CONSTRUCTION OF GARAGE WITH WORKSHOP/STORE OVER (REVISED PLANS), 38 VICTORIA ROAD, COWES, ISLE OF WIGHT

 

The Committee were advised that the application had been approved on 21 February 2003. It had been alleged that work was not being carried out in accordance with the approved plan. An inspection of the site was carried out and an amended plan was requested and consequently received.

 

The discrepancies between the approved plan and the development, which had commenced, were minor and would not have a significant impact on the amenities of the neighbouring property.

 

RESOLVED :

 

THAT the Committee formally agree that the alterations to the scheme can be treated as a minor amendment to the approved plan.

 

           (b)       E/6387/M - UNAUTHORISED USE OF A DOMESTIC GARAGE IN CONNECTION WITH THE RUNNING OF A CARPET BUSINESS AT 10 OAKHILLS, SHANKLIN, ISLE OF WIGHT

 

Members were reminded that consideration of the matter was heard at the meeting of the Development Control Committee held on 29 April 2003. At that time it was noted that in the light of actions undertaken the breach of planning control no longer existed and the Local Planning Authority proposed to take no further action.

 

On 14 May 2003, a complaint was received that a container lorry had delivered carpets to the property. An Enforcement Officer visited the site and informed the owners that they were in breach of planning control and could be subject to enforcement proceedings.

 

RESOLVED :

 

THAT an Enforcement Notice be served requiring the cessation of the unauthorised use, the removal if the carpets and the reversion of the garage to domestic use. Time for compliance one week.
