Other Matters Not Relating To Current Planning
Applications
(i) TCP/14463/D - Allegation
of untidy land at Maryland, Colwell Chine Road, Freshwater
Members gave consideration
to whether circumstances justify the service of a Notice under Section 215 of
the Town & Country Planning Act 1990, requiring the removal of a number of
motor vehicles, a touring caravan, and other items from the land.
RESOLVED :
THAT the contents of this report
be noted and accept that the site does by virtue of its present condition
adversely affect the amenities of the area. Accordingly to serve a Notice under
Section 215 of the Town & Country Planning Act 1990 requiring
(i) Removal of a white Volvo
Estate car D483 HPR, a blue Ford Escort convertible, no index plates, a grey
Nissan car A111 EDL, a white freight Rover van E588 AWV, a red Volvo Estate
G451 APK, a dilapidated white touring caravan, along with gas bottles, rusting
bicycles, metal, timber, toilet bowl, a wash basin, car wheels and tyres, and
other materials in or adjacent to the vehicles and caravan.
(ii) Clearance
of the land of bramble and weed infestation.
Members
wished time for compliance for this notice be amended from two months to one
month after the Notice takes effect.
(c) PAPER C – TCP/25508 – USE OF LAND
OPPOSITE OF GORE CEMETERY, SOUTH WEST OF ARRETON CROSS, DOWNEND ROAD, ARRETON
Member considered the
whether to take Enforcement action regarding the proposed forthcoming two-day
motorcross event, which would breach Condition 2 on Planning Decision Number
TCP/25508. That condition stated that
no events shall occur on consecutive weekend days, namely Saturday and Sunday.
RESOLVED :
THAT Members note the
proposed forthcoming Motocross FIM World Championship two-day event; the fact
that the event will breach the Condition 2 on Planning Decision Number
TCP/25508 and that, on this occasion, action will not be taken against that
breach. In addition a letter is to be
despatched, at the earliest opportunity, to the motocross organisers to advise
them of the Development Control Committee’s resolution, but that the resolution
is conditional that the authorised site and the adjoining land is restored to a
condition which existed before preparations for the event commenced, and that
the land to the south of the authorised site is returned to a condition
suitable for agriculture.
(d)
Schedule of Appeals
The Schedule of Appeals that had been lodged and decisions made was received.
RESOLVED :
THAT the report be noted.
98. URGENT BUSINESS
The Chairman agreed to two items of urgent business, as decisions or notifications were required before the next meeting.
(i) PROPOSED CHANGES TO THE CONSTITUTION WHICH REFER TO THE DEVELOPMENT CONTROL COMMITTEE PROCEDURE RULES AND CODE OF PRACTICE FOR COUNCILLORS AND OFFICERS DEALING WITH DEVELOPMENT CONTROL MATTERS
Due to the complex issues involved in the report, Members it should be taken a later date where the paper would be discussed at length.
RESOLVED :
THAT this item be deferred to a subsequent meeting of the Development Control Committee.
(ii) TCP/24460 – 2 STOREY BUILDING TO
PROVIDE 4 FLATS; ALTERATIONS TO VEHICULAR ACCESS; PARKING FOR 2 VEHICLES
(REVISED SCHEME) AT LAND BETWEEN 1 & 5 ST. JOHNS ROAD, NEWPORT
Members considered whether
in the light of a letter received from the adjoining property owner, which
stated that the above-mentioned development was not being built in accordance
with the approved plans; would the Committee accept that the revisions consider
them as an amendment to the approved plans.
RESOLVED :
THAT the developer is instructed
to cease work in order for Officers to carry out a detailed examination in
order to identify discrepancies between approved scheme and development under
construction, with particular regard to height of building. Further report to be prepared for
consideration by Members at a future meeting.
