The Director of Environment Services sought confirmation from the Committee as to its decision in relation to Minute number 15 - 3 TCP/09150/C, 4 TCP/17579/C and 5 TCP/17579/D.
RESOLVED :
THAT the Minutes of the meeting held on 3 August 2001 be confirmed.
17. DECLARATIONS OF INTEREST
Interests were declared in the following matters :
Mr G Price declared a pecuniary interest in Minute 18 (d) - Parkhurst Prison Estate, but had received dispensation from the Secretary of State under Section 97(1) of the Local Government Act 1972 which enabled him to speak on the matter.
Mr B E Abraham declared a non pecuniary interest in Minute 18 (c) - Lakeside, High Street, Wootton.
18. REPORT OF THE DIRECTOR OF ENVIRONMENT SERVICES
(a) To consider any items deferred from the last meeting of the Committee and the Site Inspection meeting
TCP/24061 - Proposed detached house and single storey rear extension to existing dwelling to provide additional living accommodation; alterations to vehicular access, provision of four off-street parking spaces (revised scheme), 24 Venner Avenue, Cowes
Members were reminded that the application had been considered at the Development Control Committee meeting held on 3 July 2001. At that meeting it was decided a site visit should take place. This was held on 13 July 2001 when consideration was deferred to allow for negotiations to take place. The Director advised members that the negotiated amendments addressed the concerns that had been raised.
RESOLVED :
THAT the application be approved subject to appropriate conditions.
(b) Proposed Article 4(2) Direction in respect of Nos. 21-63 (odd/inclusive) Carisbrooke Road, Newport
The Director of Environment Services advised members that as the Local Planning Authority, there was a need to be able to control or regulate alterations to the properties in this section of Carisbrooke Road as these could result in the loss of important architectural detailing. This would be achieved by the withdrawal of certain permitted development rights by an Article 4(2) Direction.
The Direction would be valid for a six month period and persons affected would have a chance to make written representations. The Direction would need to be confirmed within a six month period and any comments received from local residents would be taken into consideration before the Direction was confirmed.
RESOLVED :
THAT an Article 4(2) Direction be served in respect of the aforementioned properties encompassing the specific householder permitted development rights outlined in the report.
(c) TCP/18086/A - Hotel and conference centre Lakeside, High Street, Wootton, Ryde, PO33 4LJ
(Mr B E Abraham declared a non pecuniary interest in this item and took no part in the discussion thereon).
Members were reminded that the application had been considered at the Development Control Committee meeting held on 3 July 2001. At that meeting it was decided to defer consideration to allow time for officers to collect further information and clarify a number of points, but principally matters relating to foul sewage disposal and surface water drainage.
Detailed written representations had been received from the applicant's agent and Southern Water. Some discussion took place on drainage and surface water disposal.
RESOLVED :
THAT the application be approved subject to appropriate conditions.
Condition 5 to be amended to include 'managed hereafter'.
Condition 12 should include 'hereafter'.
Condition 13 amended to say '0800 hours'.
Condition 17 to be deleted.
Condition 6 regarding foul sewage should be amended to include the requirement of flow controls at busy times before the development is first brought into use.
(d) Parkhurst Prison Estate
(Mr G Price declared a pecuniary interest in this item but had received dispensation from the Secretary of State under Section 97(1) of the Local Government Act 1972 which enabled him to speak on the matter).
Members were reminded that the application had been considered at the Planning Committee meeting held on 13 March 2001. At that meeting eleven applications had been considered. Of the eleven applications, two were refused (Sites G and L) and three were approved (Sites C, D and E) with the remaining six being deferred.
The Director outlined the reasons for the deferrals and advised members that the following sites had now been brought back for consideration :
TCP/23598 - Adjacent 4 Lonsdale Avenue (Site B)
TCP/23605A - Rear of 8 - 11 Miller Close, north of Lonsdale Avenue (Site K)
TCP/23605 - Rear of 24-42 Rooke Street, west of Miller Close (Site H)
TCP/23596 - North of Nicholson street (Site A)
Members considered certain matters in respect of the applications but felt that all four applications should be deferred. This was to allow Highways Engineers and the applicants to consider a suggestion for an additional length of road to link Clissold Road with the proposed new junction at Site D, opposite St Mary's Hospital.

THAT the applications be deferred.

(b) Part IV - Items Other Than Current Issues

Members were reminded that the application was due to be considered at the Planning Committee on 15 May 2001 but was deferred at the applicant's request to allow further information in support of the proposal to come forward. A letter had now been received from the applicant's agent and the points were set out in the report, together with an appropriate response.
Although Officer's recommendation was that the Agreement be retained, members considered that advances in security in the area, particularly CCTV meant that the Agreement no longer served any useful purpose.
RESOLVED :
THAT the Section 106 Agreement restricting occupancy and disposal of the property be removed.
(b) TCP/21593 - Unauthorised separate unit of living accommodation, at Apple Tree Cottage, Blackwater Road, Newport
Officer's requested a deferral of this item to enable more information to be submitted and the possible service of a Planning Contravention Notice.
RESOLVED :
THAT the item be deferred so officers could obtain additional information, possibly by the service of a Planning Contravention Notice.
(c) At the request of the Chairman, a report for the Development Control Committee on flyposting
The Chairman presented a report on flyposting and various options were discussed.
RESOLVED :
(i) THAT a list of offenders be drawn up (with contributions sought/welcomed from members and the Parish Councils) and that those identified are written to advising them of the illegal nature of flyposting and of the Council's intention to take action in the future if repeat occurrences take place.
(ii) THAT the Head of Highways and Transportation be encouraged to utilise its powers under a Highway Act ti immediately remove any flyposting on highway and street furniture.
(iii) THAT the report be noted and the current approach of dealing with instances of flyposting on a case by case basis be continued.
(d) G/23/1/u - Unauthorised deposit of waste material on OS Parcel 4200, land adjacent the Military Road, Atherfield
Consideration was given to the service os an Enforcement Notice that required the removal of spoil from Part OS 4200 and the restoration of the land to its former condition.
RESOLVED :
THAT an Enforcement Notice be issued requiring the removal of spoil which has been deposited on the land without the benefit of planning permission and the restoration of the land to its former condition. Time for compliance - three months from when the Notice takes effect.
