92.      URGENT BUSINESS - UPDATE OF LBC/21224A THE PARTIAL DEMOLITION OF THE THREE CROWNS PUBLIC HOUSE, HIGH STREET, COWES


Members were advised that the Council’s Legal Department had been instructed on 2 December 2002 to assess whether a successful prosecution could be brought following the collapse of the Three Crowns Public House on 26 November 2002.


The case worker had requested Building Control and Planning provide statements in each of their respective specialist fields, which had been received. A 2 hour interview, under caution, was undertaken on 11 December 2002 in which the owner stated that the collapse of the building was due to its poor condition.


If sufficient evidence established that any person had done any act contrary to either Building Control or Listed Building legislation the matter would be signed off by the case worker and a summons issued.


The Council had written to East Dorset District Council on 2 January 2003 as they had had a similar incident, but a reply had not yet been received.


A report would be brought to the Development Control Committee outlining whether a prosecution was likely to be brought, on 4 February 2003.

93.      REPORT OF THE STRATEGIC DIRECTOR OF CORPORATE AND ENVIRONMENT SERVICES

 

           (a)       Interim Appeal Report

 

Members were advised on the performance for the current year. Almost 2400 planning applications had been received and an analysis of those where a decision had been taken seemed to indicate that approximately 12% of all determined applications were refused permission either under the agreed delegated procedure or by this Committee. About 20% of those decisions resulted in an appeal to the Planning Inspectorate. It was anticipated that six monthly report would be brought before the Committee on agendas immediately following the 31 March and 30 September each year.

 

The Committee thanked Mrs J Kendall for all her hard work in processing the appeals and believed the report showed that the Council were getting things right.

           (b)       The Town and Country Planning (Residential Density) (London and South East England) Direction 2002

 

Members were reminded that a report had been submitted to the Development Control Committee on 19 November 2002 in connection with the recently published Town and Country Planning (Residential Density) (London and South East England) Direction 2002, which came into effect on 2 December 2002. A letter was sent to GOSE and the Development Control Manager gave an outline of the response received.

 

RESOLVED :

 

THAT the response from GOSE to the resolution made by this Committee be noted and adopted for determining future planning applications in respect of housing and in keeping with relevant UDP policies.

Members were advised that a number of complaints had been received in respect of the siting and occupation of the caravans by the owner of Island Motor Salvage. The Committee was updated on the ongoing investigations regarding the latest breaches of planning control at the site and whether the level of evidence had reached a point where decisions could be made.

 

RESOLVED :

 

                                   (1)       THAT a Planning Contravention Notice be served on the owner of the site to clarify the residential use of the portable unit in the northwest corner of the site.

 

                                   (2)       THAT a planning application be invited (without prejudice to the final decision) for the continued use of the land in the centre of the site for the breaking and storage of vehicles together with the retention of the portakabins used as an office/reception and canteen.
