103.    URGENT BUSINESS - TCP/4720R - 33 ORCHARD ROAD, SHANKLIN

Members were reminded that the item had been considered at the Development Control Committee meeting held on 27 November 2001. At that meeting it was decided to serve a Notice under Section 215 of the Town and Country Planning Act 1990, which required the removal of weeds, brambles and self-seeded trees from the land because of the adverse effect on the amenities of the area. The original resolution had given two months to comply.

The Committee were advised that there had been some difficulty in serving the Notice on the owner and as a result of that it was suggested that the time for compliance should be reduced from two months to one month.

The Council’s Senior Solicitor explained that a process service had eventually been used to track down the owner, so service of the Section 215 could now go ahead.

RESOLVED :

THAT a Notice under Section 215 of the Town and Country Planning Act 1990 be served requiring the removal of the weeds, brambles and self-seeded trees, from 33 Orchard Road, Shanklin. Time for compliance - one month after the Notice took effect.
