29. TCP/04655/T – PRESTWOOD FARM SMALLBROOK LANE, RYDE, ISLE OF WIGHT
(During the debate Mr B E
Abraham declared a personal interest as a farmer and took no part in debate or
voting thereon).
Members gave consideration
to the demolition and removal of all farm buildings and slurry store; and the
outline for 119 dwellings, consisting of a nursing home, 28 sheltered housing
units and health centre/community building; formation of new roundabout
providing access of Brading Road; public amenity space; nature conservation
area.
The Committee were advised
that the local action group SEAGAP did not object to the application but did
raise comments and concerns. Ms
Marianne Sullivan spoke objecting to the application and Mr Jim Bailey an
agent, spoke on behalf of the applicant.
The local member addressed the Committee.
Members believed that the
scheme as set out was not acceptable, the drainage issues should be looked at,
the proposed development was too large for the footprint and there did not
appear to be any Crime and Disorder implications, which the Committee found
surprising.
RESOLVED :
THAT the planning
application be refused.

Matters Not Relating To Current Planning Applications
(i) E/13890B - Appearance of trailer body located in front garden area to Kent House, York Avenue, East Cowes
Consideration was given as to whether the current appearance of the trailer body had an adverse affect on the amenities of the area to the degree that a notice under Section 215 of the Town and Country Planning Act should be served requiring remedial works.
RESOLVED :
THAT a notice be served under
Section 215 of the Town and Country Planning Act 1990 requiring the exposed
section of the trailer to be painted a dark/matt green or brown colour, so that
the structure provided a uniform appearance.
Time period for compliance one month.
(ii) TCP/19153C – Condition of land rear
of Norman Court, Quarry View, Camp Hill, Newport, Isle of Wight
The local Member addressed the Committee. The Councils solicitor advised the Committee on s. 215 and s. 102 of the Town & Country Planning Act 1990.
Members considered whether the condition of ground on the edge of the car parking area behind the residential units harmed the amenities of the area to the degree that a notice under Section 215 of the Town and Country Planning Act 1990 requiring remedial work should be served.
RESOLVED :
THAT the information presented in the report be noted, accept that
given the distance between the material and where a member of the public stands
and from where an assessment of the condition of the site must be made, that
the circumstances did not justify the service of a notice under Section 215 of
the Town and Country Planning Act 1990 at present.
(iii) E/20324X – Erection of an abseiling
tower approved under planning permission reference TCP 20324W, but sited
incorrectly. Thorness Bay Holiday Park,
Thorness Lane, Cowes
Consideration was given as to whether circumstances
justified the service of an Enforcement Notice requiring the repositioning of
the structure to the approved location.
RESOLVED :
THAT a strongly worded letter to be written to the management of the park advising that any future breach would result in the service of an enforcement notice and to diarise for May 2004 to inspect the site as soon as the abseiling tower is re- erected
31. URGENT BUSINESS
The Chairman agreed to two items of urgent business, as decisions were required before the next meeting.
(a) RED FUNNEL (PHOENIX YARD) – INITIAL MEETING OF LOCAL FORUM
The Committee were informed
that the initial meeting of the local forum had taken place; it was generally
felt to have been successful. A second
meeting had been arranged for the 24 July 2003, to be held at East Cowes Town
Hall.
RESOLVED :
THAT the local forum be
continued and any decision on possible enforcement action be deferred on the
basis that there were definite indications of progress and, in those
circumstances, it would not be prudent to pursue any current breaches of
planning controls.
(b)
TCP/25508 – CONTINUED USE OF LAND FOR MOTOCROSS, UPGRADING OF TRACK AND
FACILITIES, LAND OPPOSITE GORE CEMETERY, SOUTH WEST OF ARRETON CROSS, DOWNEND
ROAD, ARRETON, NEWPORT
The Development Control
Manager advised the Committee that the approved decision notice had not yet
been issued. The Local Planning
Authority had been in receipt of a solicitors’ letter and were advised that
Judicial Review may be sought.
Advice was being sought from
Counsel it was anticipated that a full report would be brought back to the next
Development Control Committee.
Several Members had visited
the site and surrounding area during the national event held on Sunday 29 June
2003 and all reported that the noise nuisance was negligible and that no
complaints had been received.
RESOLVED :
THAT no enforcement action
to be taken against the Motocross Club should they hold further scheduled local
events on the site in advance of the issue of the decision notice providing
that the notice is issued within a reasonable time scale.

had been lodged and decisions made was received.
