MINUTES OF A MEETING OF THE LICENSING PANEL HELD AT COUNTY HALL, NEWPORT, ISLE OF WIGHT ON TUESDAY, 14 MAY 2002 COMMENCING AT 10.00 AM

RESOLVED :
THAT the minutes of the meeting held on 2 May 2002 be confirmed.
4. REPORT OF THE STRATEGIC DIRECTOR OF FINANCE AND INFORMATION
(a) Application for the Grant of a Street Trading Consent - Mr P Moore
The Strategic Director of Finance and Information reported that an application had been received for a Street Trading Consent for the selling of ice creams at the Pier Slipway, Esplanade, Shanklin. A letter of objection had been received from Shanklin Town Council however a letter of support had been received from the applicants local Councillor and a local resident.
The applicant outline his application and informed the Panel of the difficulties that had arisen with regard to the trailer that he intended to use last year but was unable to do so. The applicant’s local member spoke in support of the application.
The Panel adjourned to private session. Upon reconvening in public it was explained that having heard all the evidence there were no substantive objections and that the application would be approved subject to the condition that the vehicle to be utilised to be approved by the Senior Licensing Officer.
RESOLVED :
THAT a Street Trading Consent be granted to Mr Philip Moore for 18 May - 31 August 2002 on all days from 09.30 to 17.00 hours for a site at the Pier Slipway, Esplanade, Shanklin with the condition that any vehicle utilised shall first be approved by the Senior Licensing Officer.
(a) Application for the Grant of a Street Trading Consent - Mr T Yarwood
The Strategic Director of Finance and Information reported that an application had been received for a Street Trading Consent for the selling of ice creams at the Esplanade, Cowes. Objections had been received from Cowes Town Council and Wight Leisure.
The applicant outlined his application and informed the Panel on the detailed operation of the vehicle that would be used.
The Panel adjourned to private session. Upon reconvening in public it was explained that having heard all the evidence the Panel considered that there are already sufficient similar outlets in the area and therefore the application would be refused.
RESOLVED :
THAT the application for a Street Trading Consent to Mr T Yarwood for 14 days from 18 July 2002 for all days for the Esplanade, Cowes, be refused as there are already sufficient similar outlets in the area.
(a) To consider whether Mr C Davis is a Fit and Proper Person to hold a Hackney Carriage/Private Hire Driver’s Licence
The Strategic Director of Finance and Information reported that an application for a Hackney Carriage/Private Hire Driver’s Licence had been received from Mr C Davis. However as the applicant had two previous motoring offences leading to him being disqualified from driving the Strategic Director had refused the application and the applicant had now appealed against this decision.
The Applicant’s representative outlined the application and the matters that had given rise to the previous convictions, the last one of which had been more that three years ago. A character reference from Mr Davis’s current employer was also submitted/
The Panel adjourned to private session. Upon reconvening in public it was explained that having heard all the evidence, including the spent convictions, the licence should be granted subject to the CRB check showing no further convictions.
RESOLVED :
THAT Mr C Davis be granted a Hackney Carriage/Private Hire Driver’s Licence subject to the CRB check showing no further convictions.
(a) To consider whether Mr M Alston is a Fit and Proper Person to hold a Hackney Carriage/Private Hire Driver’s Licence
The Strategic Director of Finance and Information reported that an application for a Hackney Carriage/Private Hire Driver’s Licence had been received from Mr M Alston. However as the applicant had four previous convictions (including two motoring ones) the Strategic Director had refused the application and the applicant had now appealed against this decision.
The Applicant outlined the application and the circumstances leading to his conviction for the various offences the latest of which was in 1999.
The Panel adjourned to private session. Upon reconvening in public it was explained that having heard all the evidence and mindful of their duty towards the safety of the public that Mr Alston’s application be granted a licence but that the licence not to commence until the receipt of the CRB check which must show no further convictions and also subject to a written warning regarding his future conduct.
RESOLVED :
THAT Mr M Alston be granted a Hackney Carriage/Private Hire Driver’s Licence on the condition that the licence not commence until the receipt of a completed CRB check showing no other convictions and also subject to a written warning regarding his future conduct as a licensed Hackney Carriage/Private Hire Driver.
