Title: APPEAL
AGAINST PRIVATE HIRE VEHICLE LICENCE CONDITIONS WHICH PREVENT THE LICENSING OF
AN EX FIRE APPLIANCE
REPORT OF THE HEAD OF
CONSUMER PROTECTION
1. Members will recall that at the meeting of the Licensing Panel held on 16 November 2004 a report was put before the Panel to consider the above.
2. At that meeting is was resolved that:
The matter be deferred to the next meeting of the Licensing Panel, in December, by which time the Panel would require:
(a) A detailed risk assessment to be carried out by the applicant, to the satisfaction of the Licensing Officer, covering the ingress and egress to the passenger compartment from all doors;
(b) The Licensing Officer to have carried out further investigations on the issues of safety, particularly with regard to the safety of rear facing fitted seats bearing in mind the type and use of vehicle;
(c) The Licensing Officer to implement a review of the Council’s policy and to advise the Panel on issues relating to licensing conditions 14(e) to enable the Panel to reach a decision on the application at the December meeting;
(d) The Licensing Officer and the applicant to engage in meaningful discussions and negotiations throughout this period prior to the meeting.
3. As further information is still being obtained, which could allow the Council’s Principal Licensing Officer to use his delegated authority, an oral report will be given.
