Application for the Grant of an Occasional Public Entertainment Licence for Shepards Wharf Boat Yard, Medina Road, Cowes
The Strategic
Director referred to the application submitted by Mr M Friend of Oddball
Promotions, 33 St Andrews Street, Cowes for the grant of an occasional Public
Entertainment Licence for Shepards Wharf Boat Yard, Medina Road, Cowes. Copies of two letters addressed to the Senior
Licensing Officer from Mr B Oxford, who was acting as the agent for the
applicant, dated 8 February 2003 and from Mr M Friend dated 11 September 2002,
respectively, were circulated to the Panel.
An objector also provided an extract purported to be from the minutes of
the November meeting of the Cowes Harbour Commissioners and a plan of the site
concerned for the Panels attention.
The Panel, in
noting the petition received in objection to the application, were also made
aware that no objections had been received from the Hampshire Constabulary, the
local member or from Cowes Town Council.
Consideration was given to the comments of the Environmental Protection
Section, The Isle of Wight Fire and Rescue Service and the Building Control
Department.
Two objectors
were present and addressed the Panel on behalf of the signatories to the
petition.
Mr Oxford, the
applicants’ agent, and the applicant were both present and outlined the case
and the measures undertaken in an endeavour to control the noise nuisance and
enforce good order at the premises. The
applicant indicated his willingness to comply with any conditions the Panel
wished to impose, in particular to those in relation to the installation of an
electronic sound limiter and required fire regulations. The Panel were also advised that the
applicant had held discussions with Cowes Harbour Commissioners, since their
November 2002 meeting, to address their concerns regarding the entertainment
facility provided at Shepards Wharf. As
a consequence of those discussions and of those with Cowes Town Council, the
application provided a compromise by requesting the grant of a licence for
substantially reduced hours and days from that entertainment provided during
2002.
The Panel
adjourned to private session. Upon
reconvening in public the Panel indicated that careful consideration had been
given of the applicants’ history and of the evidence he had provided. The Panel had also taken into account the
evidence presented by the officers and the objectors. The grant of a licence provisional on compliance with conditions
showed the concern at the matters raised.
The grant of an Occasional Public Entertainment Licence for the reduced
hours reflected the minute from the November meeting of the Cowes Harbour
Commissioners and the evidence of the objectors. The Panel also wished to draw the applicants’ attention to all
the Councils’ standard conditions relating to disturbance and public order
(Condition 4.2) and to those relating to the use of registered door
stewards. However, this was not to
detract from the importance of all the other standard conditions. It was emphasised that breach of any of the
conditions would be viewed very seriously by the Panel and the Senior Licensing
Officer and would result in appropriate action being taken.
RESOLVED :
THAT it be agreed to
grant a provisional, occasional Public Entertainment Licence for Shepards Wharf
Boat Yard, Medina Road, Cowes subject to compliance with specific conditions
relating to a noise limiter, fire regulations and the production of an
electrical certificate and with all other relevant, standard conditions.
