LICENSING PANEL HELD AT COUNTY HALL, NEWPORT, ISLE OF WIGHT ON FRIDAY, 11

RESOLVED :
THAT the Minutes of the meeting of the Licensing Panel held on 20 September 2002 be confirmed.
21. REPORTS OF THE STRATEGIC DIRECTOR OF FINANCE AND INFORMATION AND COUNTY TREASURER
(a)
Application
for the Renewal of Public Entertainment Licence for The Balcony, The Esplanade,
Ryde
The Strategic Director reported
on an application for the renewal of a Public Entertainment Licence for The
Balcony, the Esplanade, Ryde. Four letters of objection had been received. The
Police and the Environmental Protection Section had indicated that they had no
objection to the granting of the renewal.
No objectors were present at the
meeting.
The applicant referred to the
work undertaken over the last few years to tackle the previous problems of
noise from the premises.
The Panel adjourned to private session. Upon reconvening in public it was indicated that the Panel had given careful consideration to the letters submitted by the objectors and had also noted that the objectors had not attended the meeting. The Panel are aware that this is a longstanding entertainment centre which has always complied with all the Council’s requirements and requests. The Panel considered that granting the licence is proportionate to the legitimate aim and in the public interest.
RESOLVED :
THAT the renewal of the Public Entertainment Licence,
subject to the Council’s same terms and conditions as last year, be granted for
The Balcony, The Esplanade, Ryde for:
Monday – Saturday: 1100 hours –
0200 hours the following morning
Sunday: 1200 hours – 0030 hours
the following morning
Sundays preceding a Bank Holiday
(except Easter Sunday): 1200 hours – 0200 hours the following morning.
(b)
Application
for the Grant of a Public Entertainment Licence for Flanagan’s, 7 Pier Street,
Sandown
The Strategic Director reported
on an application for the grant of a public entertainment licence for
Flanagan’s, 7 Pier Street, Sandown. Three letters of comment had been received,
along with comments from the Environment Protection Section and the Fire and
Rescue Service. The Police raised no objection to the application.
No objectors were present at the
meeting.
The applicant referred to the
work undertaken over the last few months to tackle the previous problems of
noise from the premises.
The Panel adjourned to private
session. Upon reconvening in public it was indicated that the Panel had
listened carefully to all the evidence and had read the letters from the
objectors. It was noted that the objectors had not attended and that indeed one
was a trade representative. It was noted that subject to conditions there were
no objections from the various Council departments or the Police. The Panel
considered that granting the licence was proportionate to the legitimate aim
and in the public interest.
RESOLVED :
THAT a provisional Public
Entertainment Licence be granted to Flanagan’s, 7 Pier Street, Sandown for the
times requested; this Licence only to become operative when the Fire Safety
confirm satisfactory completion of the required works and subject to the
following conditions:

Standard
Conditions including noise limiter
·
No
music to be played outside except on special occasions eg Sandown Regatta and
Sandown Carnival, and subject to the prior notification of at least 14 days and
written approval of the Licensing Officer.
(c)
To
consider whether Mr J D Keddle is a fit and proper person to be registered as a
Door Steward
The Strategic Director reported that Mr Keddle had appealed against the decision of the Licensing Panel on 16 January 2001 to refuse to register him as a door steward.
During the consideration of this item the Panel went into private session to discuss with Mr Keddle his spent convictions.
On reconvening in public Mr Keddle explained the circumstances surrounding his unspent convictions and the change in his personal circumstances that had prompted his appeal against the earlier decision of the Licensing Committee.
The Panel asked questions of Mr Keddle relating to his previous offences.
The Panel adjourned to private session. Upon reconvening in public it was indicated that the Panel had every sympathy for Mr Keddle’s personal circumstances but having taken into account the nature and severity of the offences, spent and unspent, committed by the applicant, the Panel did not feel that it would be proportionate to the legitimate aim and in the public interest to grant this application. The Panel wish to draw the applicants attention to the guidelines on the relevance of criminal convictions which clearly state tat a period of 5-7 years free of conviction should elapse before an application will be considered.
RESOLVED :
THAT application by Mr Keddle to
be a registered Door Steward be refused for the reasons stated above.
