SUMMARY/PURPOSE

 

To consider an appeal against the decision of the Licensing Committee on 16 January 2001 to refuse a door steward registration to Mr J D Keddle, 11 Hollowood Road, Alverstone Garden Village, Sandown, Isle of Wight.

 

BACKGROUND

 

1.                  A request has been received from Mr J D Keddle of 11 Hollowood Road, Alverstone Garden Village, Sandown, Isle of Wight, to reconsider the Licensing Committee’s decision of 16 January 2001 to refuse his door steward application.  Attached are copies of the minute that refused the application (Appendix 1) and a copy of Mr Keddle’s letter (Appendix 2).

 

2.         The Council’s Licensing Section received Mr J D Keddle’s Disclosure of Criminal record from Hampshire Constabulary dated 21 November 2000 which listed previous convictions which were not ‘spent’ under the terms of the Rehabilitation of Offenders Act 1974.  The convictions were for the following:

3.                  Mr Keddle had one other relevant previous conviction which was ‘spent’ under the above Act.  Members must decide whether they wish to have details of the spent conviction, and, if so, whether they wish to take it into account.

 

4.         A copy of the Council’s Guidelines on the Relevance of Convictions is attached (Appendix 3).

 

LEGAL IMPLICATIONS

 

1.         The Panel’s attention is drawn to Section 17 of the Crime and Disorder Act 1998 which requires local authorities to consider the crime and disorder implications of ALL their activities.  This is a corporate responsibility of the authority as a whole.  Advice will be available during the course of the meeting on any matters raised by the applicant or objectors.

 

2.         Members are advised that this application should be considered against a background of the implications of the Human Rights Act 1998.  The report does not include a recommendation, however, reasons have to be given for any decision made by the Panel.

 

OPTIONS

 

(a)        To grant a Door Steward Registration.

 

(b)        To refuse the Door Steward Registration.

 

(c)        To grant the Door Steward Registration with a written warning with regards to his future conduct as a registered Door Steward.

 

 

RECOMMENDATIONS
