Title :              DISPOSAL OF SURPLUS PROPERTY - A TERRACE OF SIX GARAGES AT WESTVIEW, CHALE

SUMMARY/PURPOSE


This report brings to the Executive a proposal that this property be declared surplus to Council requirements and sold at the agreed price.


BACKGROUND


As part of the Assets Disposal Programme in December 1996 this property was identified for disposal and has been marketed through local agents during this period.


The property forms a non-operational asset comprising six garages, five of which are let and one which is used for Council storage. An adjoining landowner has been gaining access over part of this land, as indicated blue, for some time and contests that he has a right of way. Attempts have been made to resolve this issue in the past but without success. This has prevented a number of sales proceeding, particularly to those with hopes of redevelopment.


The Council’s present agents have been offering the property for sale since September 1999 at a guide price of £10-12,000 with their recommendation that the Council considers all offers above £8,000.


OUTCOME OF CONSULTATIONS


Chale Parish Council have been advised of this proposed disposal.


FINANCIAL IMPLICATIONS


Capital receipt with potential for 50% of any increase as a result of development of the site within the next ten years, set against which is the loss of rent from the five garages and one garage for Council storage purposes.


PLANNING HISTORY


The Planning Officer has no comments in respect of this proposed disposal.


LEGAL IMPLICATIONS


The Council’s title to the land at Chale is freehold subject to the four garage licences and a disputed right of way across the site. One of the garages is now vacant.

1.        Retain the property.

 

2.        Dispose of the property on the terms stated in the confidential paper.
