PLAN
REPORT OF THE PORTFOLIO HOLDER CHILDREN’S
SERVICES

1.
To approve an action plan in response to the 2003 Office
for Standards in Education (OFSTED) and Adult Learning Inspectorate ( ALI) inspection
of 14-19 provision on the Isle of Wight. The Action Plan is available on the
Council’s website:

This decision has not appeared on
the forward plan due to the complexity of the task of drafting the action plan
and the need to widely consult leading to uncertainty about when the draft
would be finished and ready for approval. The decision cannot wait until the
publication of the next forward plan due to the need to comply with the
timetable referred to below.

OFSTED and
ALI undertook a joint inspection of 14 to 19 education and training in the Isle
of Wight during the weeks of 29th September-3rd October
and 10-14 November 2003. This inspection was carried out under Section 65 of
the Learning and Skills Act 2000, as amended by the Education Act 2002. The
report was published in March 2004.

It is a
statutory requirement that the Learning and Skills Council (LSC) and the Local
Education Authority (LEA) prepare and present to
the Department for Education and Skills (DfES) an action plan within three
working months of the publication of a section 65 inspection report.

This action
plan must demonstrate the LSC and LEA’s response to all recommendations
contained within the section 65 inspection report.
5.
The action
plan must have subsequent ministerial approval.
6.
Without approval of the action plan the Council is in
breach of the section 65 inspection regulations.
7.
Consultation on the action plan has taken place with
the Portfolio Holder for the Children’s Services Directorate, the Select
Committee for Children’s Services, and representatives from the providers of
education and training on the Island. The OFSTED section 65 inspection report
has been considered by the Select Committee.

Further discussion have taken place with the DfES and
the LSC National Office on the appropriateness of the actions described in the
plan.

The financial costs related to this decision are set
out within the action plan. All costs are met by the LSC or contained within
the Directorate of Education and Community Development budget.
10. Approval of the action plan is a
statutory requirement under the section 65 and associated regulations.

Two options exist:
a)
Approve the action plan.
b) Require
further Officer work on the action plan.
12.
Option (a) ensures that the Council fully meets its
statutory requirements in respect to section 65 inspections under the Learning
and Skills Act 2000.
13.
Option (b) would require an extension of the action
plan preparation period from the DfES . It is currently Officers best
professional judgement that the action plan, as submitted meets the
recommendation requirements of the inspection report.
