RENOVATION/RESTORATION OF LYNNBOTTOM LANDFILL SITE

PORTFOLIO HOLDER - PUBLIC, ENVIRONMENT PROTECTION AND WASTE


SUMMARY/PURPOSE

To agree the release of funds from the Repairs and Renewals Fund for the final phase of the restoration / renovation of the Lynnbottom Landfill Site and the acceptance of the lowest tender.

BACKGROUND

The planning and licensing conditions attached to the Lynnbottom Landfill Site require the capping and restoration of the site to be commenced within six months of the closure of the site. The site has not accepted any domestic waste since the opening of Standen Heath in April 2000 and has not accepted any inert waste in the current financial year.

Previous phases of the restoration were funded by Special Supplementary Credit Approvals from central government but in April 2000 such funding was stopped as the government diverted the funds for the restoration of contaminated land under the requirements of Part 11A of the Environment Protection Act 1990 which were brought into force at that time by Section 57 of the Environment Act 1995.

No formal budget provision exists for this scheme, which has been assumed for capital financing purposes to be met from the Repairs and Renewals Fund Capital Programme (report of 22 March 2001 refers).

Tenders were invited from the four contractors who expressed interest and met the Council's requirements and three tenders were returned on 13 August 2001 with the other prospective tenderer writing to say that he was not tendering as he had just been awarded two other contracts and did not therefore have the necessary resources.

I am recommending the acceptance of the lowest tender, technically acceptable, and the intention is to start the works on 10 September 2001 with a twelve week contract period to allow completion by the end of November.

FINANCIAL IMPLICATIONS

Provision is available in the Repairs and Renewals Fund.

LEGAL IMPLICATIONS

By commencing the works in September the Council avoids any possibility of action by the Environment Agency concerning failure to restore or renovate the site.

OPTIONS

To agree the release of the available funding and the acceptance of the tender.

RECOMMENDATION

The Executive is asked to agree the release of �1,012,324.62 from the Repairs and Renewals Fund and the acceptance of the lowest, technically acceptable, tender.
