At the last meeting of the Executive an update on the current situation was promised.
BACKGROUND
Following the resolution of the Executive on 12 February 2002, the Order and the accompanying Statement Of Reasons have been drafted.
In
view of the likelihood of a contested public inquiry, it was decided to brief
Counsel, and to ask for his approval of the drafts before publication. The
draft documents together with draft statements of evidence have gone to
Counsel, and he is expected to advise in a conference on 4 July. Statements
have been made by the Development Control Manager, the Chief Environmental
Protection Officer, the District Valuer and the Head of Property Services.
Following that conference the Order will be made and published.
The residents association (SEAGAP) and the Local Government Ombudsman are being kept informed of progress.
The Property Services Manager continues to keep in touch with the landowner and agent to try and reach a negotiated settlement.
LEGAL IMPLICATIONS
When the Order is made and published notice is served on the landowner, and there is a period of 21 days for objection. If objections are received the Secretary of State is expected to hold a public local inquiry.
There will be a cost to briefing Counsel. This was included in the estimated cost previously given.
