SUMMARY/PURPOSE

 

Under the terms of the School Standards and Framework Act 1998 all schools are responsible for maintaining their Instruments of Government.  Instruments of Government are concerned with the membership of governing bodies (not with governors’ powers or procedures).  It is for school governing bodies to propose new Instruments for the approval of the Local Education Authority.  Medina House School has submitted a new Instrument of Government for approval.

 

BACKGROUND

 

All Island schools drew up new Instruments of Government for implementation in September 1999, as required by the School Standards and Framework Act 1998.  The Act lays down the format of the Instrument and specifies the number of options as to the size of the governing body.  The Instrument is the document where the formal name of the school is recorded.  The Instruments for all Island schools were considered and approved by the Panel of the Education Committee.  Medina House School has submitted a request to amend their Instrument of Government.

 

Medina House School is seeking to increase the number of governors on the Governing Body.  The Schools Standards and Framework Act 1998 allows a school size of Medina House, to have either 9, 10, 13 or 17 governors (including the Headteacher).  Medina House School chose to have 10 governors.  Since the approval of that Instrument, the Governing Body is seeking to increase its size to 13 (including the Headteacher) so that the Governing Body can function more effectively.

 

RECOMMENDATIONS

 

That the Committee approve the revised Instrument of Government for Medina House School.

INSTRUMENT OF GOVERNMENT: COMMUNITY SCHOOLS

 

 

 

 

1.         The name of the school is MEDINA HOUSE SCHOOL         

 

2.         The school is a community school

 

3.         The name of the governing body is THE GOVERNING BODY OF MEDINA HOUSE           SCHOOL

 

4.         The governing body shall consist of:

 

            (a)        4          parent governors

           

            (b)        3          LEA governors

 

            (c)        1          teacher governor

 

            (d)        1          staff governor

 

            (e)        3          co-opted governors

 

            (f)         the head teacher (except at any time when he has given written notice to the clerk to

                        the governing body of the school that he chooses not to be a governor).

 

5.         Total number of governors 13 (except at any time when the head teacher has given notice as      above that he chooses not to be a governor, when the total number of governors will be 12)

 

6.         Subject to regulation 5(4) of the Education (School Government) (Transition to New     Framework) Regulations 1998, this instrument of government comes into effect:

            -           on the date of making for the purpose of reconstituting the governing body;

            -           on 1st September 1999 for all other purposes.
