26.             REPORT OF THE HEAD OF CONSUMER PROTECTION

 

Consideration was given to Paper B, the report of the Head of Consumer Protection, providing details of the application received from James King, Licence and Events Manager of Loudsound Events Ltd/Bestival Ltd for the grant of an occasional Public Entertainment Licence, and an application under the Isle of Wight Act, for the Bestival, Robin Hill Country Park, Downend Road, Newport.

 

The Sub Committee followed the agreed procedure, which had been previously circulated to all parties prior to the meeting and presented the following decision and the reasons for that decision.

 

RESOLVED:

 

THAT upon receiving the report of the Licensing section, written and oral evidence from the interested parties following formal consultation and written third party representation, the application be determined as detailed below:

Saturday, 10 September 2005: 1100 hours – 0200 hours the following morning

Sunday, 11 September 2005: 1100 hours – 2400 hours

10,000 per day, 30,000 in total

Comments :

The third party objector, Mr M Graves did not attend.

The Isle of Wight Magistrates’ Court had not received an occasional Liquor Licence application at the time of writing the report.

The Sub Committee were informed that a copy of the contract in relation to the disposal of all waste with Southern Water had been received by the Licensing Section prior to the meeting.

Reasons for Decision:

The reasons were provided in the report, which would minimise the risk of poor water pressure to nearby residents and to prevent any environmental damage.

The Sub Committee had regard to the Human Rights Act 1998, and in particular Article 1 of the First Protocol, Article 6 and Article 8.  The Sub Committee considered their decision to be proportionate and in accordance with the legitimate aims of the Council

Resolution:

THAT a Public Entertainment Licence be granted to James King, Licence and Event Manager, Loudsound Events Ltd/Bestival Ltd, 78 Westbourne Park Villas, London subject to the Council’s standard terms and conditions for outdoor Public Entertainment and the Isle of Wight Act and subject to the following condition:

Conditions:

A written undertaking to be given by the applicant that water tankers will be contracted for daily deliveries for the site, to meet requirements.
