MINUTES OF A MEETING OF THE HUMAN RESOURCES AND MISCELLANEOUS APPEALS SUB COMMITTEE HELD AT COUNTY HALL, NEWPORT, ISLE OF WIGHT ON FRIDAY, 3 MARCH 2006 COMMENCING AT 10.00 AM

3.                  MINUTES

 

RESOLVED :

 

THAT subject to the inclusion of Cllr Taylor on the list of members present, that the Minutes be confirmed.

 

4.                  DECLARATIONS OF INTEREST

 

There were no declarations at this stage.

 

5.                  APPOINTMENT TO INDEPENDENT EDUCATION APPEALS PANEL

 

The Chairman advised members that following interviews held by the Chairman and the Commissioner for Children and School Results, it was recommended that the following persons be appointed independent education appeals panel members : Mr Torr, Mrs Ford, Mrs Myland and Mrs Wood and Mrs Downing.

 

            RESOLVED :

 

a)                 THAT the persons listed above be appointed as either Lay Members or those with experience in Education to the Pool of members from which independent Appeals Panels may be drawn.

 

b)                 THAT the appointed members be confirmed as representatives from whom the Dicocesan Education Authorities may choose to appoint to the Appeals Panels in respect of aided school appeals.

 

6.                  EXCLUSION OF PUBLIC AND PRESS

           

RESOLVED :

 

THAT under Section 100(A)(4) of the Local Government Act 1972, the public and press be excluded from the meeting for the following item of business, namely Minute 7, on the grounds that there was likely to be disclosure of exempt information as defined in Paragraph 12 of Part 1 and 2 of Schedule 12A of the Act.

 

7.                  GRIEVANCE APPEAL

 

The Chairman welcomed those present to the appeal hearing and outlined the procedure that the meeting would follow. Following representations from all parties, the Panel adjourned into private session to consider the appeal. Upon reconvening the Committee :

 

RESOLVED :

 

THAT the Committee believed that the Council’s policy had been correctly applied. However after due consideration the Committee had reached a unanimous decision which does not set a precedent for the Isle of Wight Council but after hearing all the evidence the Committees prepared to recommend an ex-gratia payment.

 

The decision of the panel was final and there were no further rights of appeal.
