Appeals received

 

During 2005/2006 there were 143 appeals lodged compared to 114 in 2004/2005.   This represents a 25% increase.   Nationally, there are no published figures for the number of appeals lodged in 2005/2006.

 

Appeals determined

 

During 2005/2006, 143 appeal decisions were issued by the Planning Inspectorate as compared to 74 for the previous year.   8 cases were withdrawn before determination as compared to 9 cases the previous year.

Appeal procedure

 

Of the 143 appeals determined in 2005/2006, the majority continue to proceed under the written representation procedure with only 9 cases being dealt with at hearings and 2 cases at inquiries.

 

 

 

Outstanding appeals and timeliness

 

There are currently 58 appeals still in progress.   At the same time last year there were 67.   Members will recall at 31 March 2005 it being reported that the Planning Inspectorate had a backlog of planning appeals.   This was attributed to a number of factors including the reduction in the period of time in which to lodge an appeal.    The Secretary of State subsequently reinstated the 6 month appeal period and measures were put in place by the Planning Inspectorate to tackle the backlog.   These have been largely successful for written representation appeals but hearing appeals are still taking in excess of 12 months to be determined.

 

 

The latest published Planning Inspectorate performance targets (subject to formal announcement) for deciding appeals for the period ending 2005/2006 are set out as follows:

Conclusions

 

Whilst the number of appeals against decisions of the IW Council has increased, the overall appeal success rate has remained relatively constant at a figure well below the national average.
