RESOLVED :

 

THAT the Minutes of the meeting held on 9 August 2005 be confirmed, subject to the addition of Cllr Arthur Taylor’s name to Minute 11 (a) item 6, showing as having voted against the application.

Cllr Henry Adams declared a personal interest in Minute 14 item 2, 26 Bellevue Road, Ryde, as he was a nearby neighbour.

 

Cllr William Burt declared a personal interest in Minute 14 items, 3, 4 and 5, Cheverton Chalk and Gravel, Cheverton Shute, Shorwell, as he knew the applicant.

Officers advised that as sizable representations had been sent by the applicant to members of the Committee over the course of the previous weekend and as officers had not seen the information until shortly before the meeting, members were asked to defer the application to the next meeting of the Committee to enable officers to assess the additional information.  Members were further advised that had they determined the application and relied upon information not properly in the public domain it might lead to a judicial challenge.

 

Decision:

The application be deferred to the Development Control Sub Committee due to be held on Tuesday, 4 October 2005.

Comment:

The Local Member, Miss Anne Bishop, spoke on this item.

 

Decision:

The application was granted temporary planning permission for two school years, this current one being the first of those two years, contrary to officer recommendation.

 

In compliance with the Council’s Constitution a named vote was taken as the application was contrary to officer recommendation :

Conditions:

1.    The use hereby permitted shall be discontinued on or before 31 July 2007 unless otherwise agreed in writing by the Local Planning Authority.

 

        Reason:  To allow the Local Planning Authority to monitor the impact of the use on the amenity of the surrounding area and to ensure that material progress has been made and maintained in the enforcement of the School Travel Plan submitted to the Local Planning Authority under cover of the letter dated 15 July 2005 from Mr Hepburn, in accordance with Policies S6 (High Standard of Design) and D1 (Standards of Design) of the Isle of Wight Unitary Development Plan.

 

2.    No later than 1 month after the end of each term, there shall be submitted to and approved by the Local Planning Authority a report setting out the results of the school’s monitoring of the School Travel Plan set against the targets shown in the Plan using a methodology agreed in writing by the Local Planning Authority. The draft details of this methodology shall be submitted to and approved by the Local Planning Authority within 1 month of the date of this permission.

 

       Reason: To ensure that the proposals in the plan are properly and robustly monitored and reported upon and to enable the Local Planning Authority to take a considered view of the continued acceptability of this use at the end of the permission in accordance with Policies TR3 (Locating Development to Minimise the need to Travel), TR4 (Transport Statement Requirements for Developments) and TR7 (Highway Considerations for New Development) of the Isle of Wight Unitary Development Plan.

 

3.   The development shall not be occupied until sight lines have been provided of x = 2.4 metres by y = 54 metres.  Nothing that may cause an obstruction to visibility shall at any time be placed or be permitted to remain within that visibility splay.

 

Reason:  In the interests of highway safety and to comply with policy TR7 (Highway Considerations) of the Isle of Wight Unitary Development Plan.

 

4.   Notwithstanding the details shown on drawing PSCHOOL.1/1, within 1 month of the date of this permission there shall be submitted to the Local Planning Authority for its approval in writing an acceptable scheme showing an access width of a minimum of 5m commencing at the back edge of the footway for a minimum distance of 10m into the site. Such drawing is to be to the same level of detail as drawing PSCHOOL.1/1, such scheme as may be approved shall be implemented and completed to the satisfaction of the Local Planning Authority within 3 months of the Council giving its written approval to the details.

 

Reason: In the interest of removing conflicting traffic movements and possible congestion within the site and in the interests of highway and pedestrian safety, in accordance with Policies TR7 (Highway Considerations for New Development) and D1 (Standards of Design) of the Isle of Wight Unitary Development Plan.

 

5.   Notwithstanding the details shown on drawing PSCHOOL.1/1, within 1 month of the date of this permission there shall be submitted to the Local Planning Authority for its approval in writing details showing the relocation of the existing vehicular gate to a position of at least 5m behind the back edge of the footway and allowing for a clear width between the gate posts of a minimum of 5m and such scheme as may be approved shall be implemented and completed to the satisfaction of the Local Planning Authority within 3 months of the Council giving its written approval to the details.

 

Reason: In the interests of highway and pedestrian safety, in accordance with Policies TR7 (Highway Considerations for New Development) and D1 (Standards of Design) of the Isle of Wight Unitary Development Plan.

 

6.   Within 1 month of the date of this permission there shall be submitted for approval in writing by the Local Planning Authority a scheme of landscaping, which shall include indications of all existing trees and hedgerows on the land, and details of any to be retained, together with measures for their protection in the course of development.

 

Reason:  To ensure the appearance of the development is satisfactory and to comply with policy D3 (Landscaping) of the Isle of Wight Unitary Development Plan.

 

7.  Soft landscape works shall include planting plans; written specifications (including cultivation and other operations associated with plant and grass establishment); schedules of plants, noting species, plant sizes and proposed numbers/densities; an implementation programme.

 

Reason:  To ensure the appearance of the development is satisfactory and to comply with policy D3 (Landscaping) of the Isle of Wight Unitary Development Plan.

 

8.   All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings and any trees or plants which within a period of 5 years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless the Local Planning Authority gives written consent to any variation.

 

Reason:  To ensure the appearance of the development is satisfactory and to comply with policy D3 (Landscaping) of the Isle of Wight Unitary Development Plan.

 

9.  The car parking area hereby permitted shall be created in accordance with the details shown in drawing PSCHOOL.1/1 unless otherwise agreed in writing by the Local Planning Authority and shall be laid out, marked out and permanently set aside for the sole purpose of parking cars and for no other purposes whatsoever no later than the timescale for completion of the works referred to in Conditions 4 and 5 above.

 

Reason:  In the interests of the amenities of the area and to comply with policy D1 (Standards of Design) and TR16 (Parking Considerations for New Development) of the Isle of Wight Unitary Development Plan.

15.             ABSENCE OF CHAIRMAN AND VICE CHAIRMAN

 

As both the Chairman and Vice Chairman were unavailable from 10th – 26th September 2005 there was a need to nominate a member of the Sub-Committee to undertake, for that period, the role of the Chairman as consultee for officers taking delegated decisions.

 

It was proposed and seconded that Cllr Ivan Bulwer be nominated to take the role of consultee for officers.  There were no further nominations and following a vote by a show of hands it was :

 

RESOLVED :

 

THAT Cllr Ivan Bulwer take the role of consultee for officers taking delegated decisions during the absence of the Chairman and Vice Chairman.


16.             MEMBERS’ QUESTION TIME

 

Cllr Julian Whittaker asked why Mr Peter Tuson was allowed to speak when his name had not been on the list for public speaking.  He was advised that Mr Tuson’s name had accidentally been omitted.

 

Cllr David Whittaker asked if the Council were covered by copyright for the plans that were available on the web site.  He was advised that the Council had exclusion under the Copyright and Designs Act 1998.
