RESOLVED :

 

THAT the Minutes of the meeting held on 20 December 2005 be confirmed.

 

42.             DECLARATIONS OF INTEREST

 

Interests were declared in the following matters:

 

Cllr Muriel Miller declared a personal interest in Minute 42 (a) (2) – Land bounded by Kingston Farm Lane/Cadets Walk/Beatrice Avenue, East Cowes power station/agricultural land/south of East Cowes Vics football ground including land off Whippingham Road, East Cowes as she was a governor of Osborne Middle School and knew the applicants agent.

 

Cllr Arthur Taylor declared a personal interest in Minute 42 (a) (2) - Land bounded by Kingston Farm Lane/Cadets Walk/Beatrice Avenue, East Cowes power station/agricultural land/south of East Cowes Vics football ground including land off Whippingham Road, East Cowes as he knew the applicants agent.

 

Cllr Henry Adams declared a personal and prejudicial interest in Minute 42 (a) 3 and 4 – Bellevue Garage, 3a East Street, Ryde as he owned an adjacent business – he was not present during the discussion and voting thereon.

 

Cllr Arthur Taylor declared a personal interest in Minute 42 (a) (6) – 19 John Street and garage/workshop Carters Mews off John Street, Ryde as he knew the objectors.

 

Cllr Brian Mosdell declared a personal interest in Minute 42 (a) (6) – 19 John Street and garage/workshop Carters Mews off John Street, Ryde as he knew people in the area.

 

Cllr Arthur Taylor declared a personal interest in Minute 42 (a) (7) – Greenmount Primary School, Green Street and 43 Newport Street, Ryde as he was a governor of the school.

 

Cllr Roger Mazillius declared a personal and prejudicial interest in Minute 42 (a) 8 – 36 Fieldway Crescent, Cowes as he lived in close proximity to the application site and had submitted an objection – he was not present during the discussion and voting thereon.

 

Cllr Susan Scoccia declared a personal and prejudicial interest in Minute 42 (b) (C1) – Land at junction of High Street and Rectory Drive, Wootton Bridge as her business supplied Tesco - she was not present during the discussion and voting thereon.

 

Mr Andrew Pegram, Development Control Manager, declared a personal and prejudicial interest in Minute 42 (b) (C1) – Land at junction of High Street and Rectory Drive, Wootton Bridge as his wife was employed by Tesco - he was not present during the discussion and voting thereon.

 

Mr Justin Thorne, Legal Executive - declared a personal and prejudicial interest in Minute 42 (b) (C1) – Land at junction of High Street and Rectory Drive, Wootton Bridge as an objector was a personal friend.

Details:

Outline consent for 9.9 hectares of residential development; 9.9 hectares of employment development; managed woodland; nature conservation areas; proposed access road junction with Whippingham Road and Beatrice Avenue; network of public footpaths/cycleways; public transport link only to Kingston Road.

Additional Representations:

A letter had been received from SEEDA’s Regional Planner who indicated that they generally support the application but raised two concerns.  The first was the provision of 25% affordable housing as opposed to 30% with the second being too much development at any one time may have a detrimental effect on the local community.

 

A letter was received from Barratts and circulated at the meeting.

 

The MP had raised concerns on the grounds that brownfield sites were available within East Cowes.

 

Comment:

The local member, Cllr Charlie Hancock, spoke on this item.

 

Cllr Margaret Webster, adjoining ward member, spoke on this item.

 

Decision:

The application was refused contrary to officer recommendation as members believed there was over development of the site, failure to make adequate provision for locally affordable housing and alternative brownfield sites were available within the area and encouraged reliance upon the car to access facilities.

 

In compliance with the Council’s Constitution a named vote was taken as the decision was contrary to officer recommendation.

Reasons:

1.             The site was a Greenfield location in an area that had alternative brownfield opportunities and would create a development that was not adequately linked to or integrated with the adjacent urban area and encouraged reliance upon the car to access facilities and as such was contrary to guidance provided by Planning Policy Statement (PPS) 1 – Delivering Sustainable Development and PPS 7 – Development in the Countryside and was contrary to Policies S1 (Development to be concentrated within existing urban areas), S2 (Development to be encouraged on brownfield sites) and S11 (Reduction of the impact and reliance on the car) of the Isle of Wight Unitary Development Plan.

 

2.             The proposals fail to make adequate provision for locally affordable housing depriving the whole community access to housing and was contrary to guidance provided by Planning Policy Guidance Note 3 (Housing) and Policy H14 (Locally affordable housing as an element of housing schemes) of the Isle of Wight Unitary Development Plan.

 

3.             The proposals would represent an over-development of the site at an excessive density, in an area that was not close to local facilities and would be out of character with the prevailing pattern of development of the surrounding area and was contrary to Policy H6 (High density residential development) of the Isle of Wight Unitary Development Plan.

The application was refused contrary to officer recommendation as members believed there would be an unacceptable impact on the amenities of residential properties to the west of the site and the access and vehicular arrangements within the car park were unsafe.

Reasons:

1.    The proposed development, by virtue of its size, position and opening hours, would have unacceptable impact on the amenities of residential properties to the immediate west of the site in Rectory Drive, Wootton.  As such the proposal would be contrary to the provisions of Policy D1(b) (Standards of Design) of the Isle of Wight Unitary Development Plan.

 

2.    The proposed access and vehicular circulation arrangements within the car park would conflict with the character of the locality and would fail to provide for safe and convenient access and circulation for the public.  As such the proposal would be contrary to the provisions of Policies D1(d) (Standards of Design) and TR7 (Highway Considerations for New Development) of the Isle of Wight Unitary Development Plan.
